HomeMy WebLinkAboutORD 0993ORD 0993pT3(ÌìÝèORDINANCE NO. 993 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-3, TO R-3 PD) ON APPROXIMATELY 1.93 ACRES. APPLICANT: JOE MORENO; CASE NO.: Z-480; LOCATION: 3124-38 VINELAND AVENUE). THE CITY ORDAIN AS FOLLOWS: COUNCIL OF THE CITY OF BALDWIN PARK DOES SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) b) c) That an application for a change of zone from R-3, High Density Residential to R-3 PD) High Density Residential Planned Development Overlay zone was submitted by the owners of real property located at 3124-28 Vineland Avenue, described, more particu- larly as follows: Parcels 113, 114, and 115 on Page 19 of Map Book 8555 of the Los Angeles County Assessor's Records as shown on Exhibit A"). That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to R-3 PD); and d) That the hearing on presented, site, it necessity, the change City Council conducted a duly noticed said matter, and based upon the evidence and each member being familiar with the was determined that the public interest/ convenience, and general welfare require in zone classification, herein described. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
