HomeMy WebLinkAboutORD 0995ORD 0995pT3(ÌìÞORDINANCE NO. 995 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM R-3, TO R-3 PD) ON APPROXIMATELY 1.46 ACRES APPLICANT: AMENITIES DEVELOPMENT CASE NO.: Z-481; LOCATION: 3206-20 VINELAND AVENUE). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine/ and declare as follows: a) That an application for a change of zone from R-3, High Density Residential to R-3 PD) High Density Residential Planned Development Overlay zone was submitted by the owners of real property located at 3206-20 Vineland Avenue, described, more particu- larly as follows: Parcels 4, 5, 6 and 7 on Page 20 of Map Book 8555 of the Los Angeles County Assessor's Records as shown on Exhibit A"). b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to R-3 PD); and d) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 12.54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-3 to R-3 PD). SECTION 3. That the City Council at the time of the pub- lic hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the city Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
