AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK AMEND-
ING CERTAIN OF THE CITY ZONING
REGULATIONS RELATING TO AUTOMOBILE
SERVICE STATIONS NO. AZC-121).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY
ORDAIN AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine and declare, as follows:
a) That on the 24th day of August, 1988,
the Planning Commission held a duly noticed public
hearing on the application for an amendment to the
Baldwin Park Zoning Code; and
b) That the Planning Commission determined
that the proposed amendment would unjustly penalize
those service stations containing less than 20,000
square feet which dispense diesel fuel but do not
cater to large diesel trucks; and
c) That a number of service stations
located within the City of Baldwin Park provide for
the sale of diesel fuel; and
d) That some of the stations offering the
sale of diesel fuel are located on small lots taking
vehicular access from busy public streets; and
e) That some of the service stations who
engage in the sale of diesel fuel offer such fuel to
heavy long-bodied, diesel fuel trucks; and
f) That many of the service stations
offering the sale of diesel fuel to such trucks are
on sites which are inadequate in size to accommodate
such vehicles and do not have an adequate on-site
vehicular pattern to permit such vehicles thereon/-
and
g) That the many examples given to this
City Council, by members of the public and by its
Staff, demonstrate that safety problems result from
the servicing of such trucks by service stations
located on lots having inadequate size and/or
inadequate on-site vehicular traffic routes which
result directly in interference with the flow of
traffic on adjacent heavily traveled public streets;
and
h) That in many cases trucks have been
observed blocking sidewalks while obtaining fuel
forcing pedestrians to walk unto the traveled right-
of-way with the attendant danger to them; and
i) That the enactment of this Ordinance is
necessary to protect the peace, health and safety of
the City and its residents.
SECTION 2. That Section 17.36.035 and Section 17.36.175
are hereby added to the Baldwin Park Municipal Code to read;
respectively, as follows:

17.36*035 Minimum lot area sale of diesel fuel.
The minimum lot area of any lot upon which a service
station, which is designed to, or has the facilities
for the dispensing of diesel fuel is located or is
proposed to be located, on and after the effective
date of this section, shall have not less than twenty
thousand 20,000) square feet of lot area."
17.36.175 Nonconforming service stations sale of
diesel fuel. Notwithstanding any other provisions of
this Code, any existing service station which is
designed to, or has the facilities for the dispensing
of diesel fuel which are nonconforming by reason of
substandard lot area shall discontinue to dispense
diesel fuel within one hundred and eighty 180) days
of the effective date of this Ordinance No.
SECTION 3. That the City Council at the time of the
public hearing on the above matter reviewed and considered the proposed
Negative Declaration, and comments relating thereto. That the City
Council, based upon its public review, does hereby approve the proposed
Negative Declaration, since there is not substantial evidence that the
project will have a significant effect on the environment.
SECTION 4. That the City Clerk shall certify to the
the adoption of this Ordinance and shall cause a copy of the same to be
published in the manner prescribed by law, and shall forward a copy of
the same to the Secretary of the Planning Commission. The City Clerk
shall file the Negative Declaration of Environmental Impact.
