HomeMy WebLinkAboutORD 0998ORD 0998pT3(ÌìÝÜORDINANCE NO. 998 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A CHANGE OF ZONE FROM R-l PD) SINGLE FAMILY RESIDENTIAL PLANNED DEVELOPMENT OVERLAY ZONE TO R-l, SINGLE FAMILY RESIDENTIAL ON 5.75 ACRES APPLICANT: RICHARD & PAMELA NOTTINGHAM AND THE CITY OF BALDWIN PARK; CASE NO.: Z-482; LOCATION: 13006 THRU 13088 E. AMAR AND 738 AND 760 FRAZIER. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That an application for a change of zone from R-l PD)/ Single Family Residential Planned Development Overlay Zone to R-l, Single Family Re- sidential zone was submitted by the owners of real property located at 13012 E. Amar Road for real properties described, more particularly as Parcels 1- 19 and 38-42 on Page 15 of Map Book 8564 of the Los Angeles County Assessor's Records as shown on Exhbit B"); and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq. of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare required that it recommend the approval of the reclassification to R-l; and d) That the city Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare require the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Section 12,54 of the Baldwin Park Municipal Code, the zoning classification of the property is hereby reclassified from zone R-l PD) to R-l. SECTION 3. That the City Council at the time of the pub- lic hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its pubic review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant effect on the environment. That the City Clerk shall certify to the adop- tion of this Ordinance and shall cause a copy of the same to be pub- lished in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission.
