HomeMy WebLinkAboutORD 1015ORD 1015pT3(ÌìÀ» ORDINANCE NO. 1015 A ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM I INDUSTRIAL TO I PD) INDUSTRIAL PLANNING DEVELOPMENT OVERLAY ON 6.36 ACRES CASE NO: Z-486; APPLICANT: ROCKLEDGE ASSOCIATES; LOCATION; EAST OF I-605 FREEWAY, WEST OF LITTLEJOHN STREET, SOUTH OF OLIVE STREET AND NORTH OF LOS ANGELES STREET, LOT 18 OF PARCEL MAP NO. 1142) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows a) That an application Application') for a change in zone classsified from zone I" to zone I(PD) was submitted by the owners of certain real property, located east of I 605 freeway, west of Littlejohn Street, more particularly described as Lot 18 of Parcel Map No 1142, property') on file in the office of the director of Community Development; and b) That pursuant to the applicable provisions of the Planning and zoning law Section 65800 et seq. of the Government Code of the State of California) studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and c) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it recommended approval of the Application; and d) That the City Council conducted a duly noticed public hearing upon said matter and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity and convenience, and general welfare require the change in zone classification, herein described. SECTION 2 That notwithstanding the provisions of Section 17.06.020 of the Baldwin Park Municipal Code, the 17.06.020 of the Baldwin Park Municipal Code, the zoning class ification of the Property is hereby reclassified from zone I to Zone I PD) SECTION 3, That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration, and comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no Substantial evidence that the project will have a significant effect on the environment. The City Clerk shall file the Negative Declaration of Environmental impact. I. That the City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to Secretary of the Planning Commission.
