HomeMy WebLinkAboutORD 1017ORD 1017pT3(ÌìÀ³ ORDINANCE NO.1017 AN ORDINANCE OF THE CITY OF BALDWIN PARK AMENDING THE MUNICIPAL CODE RELATING TO RECOVERY COSTS ASSOCIATED WITH EMERGENCY RESPONSES THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That Chapter 9.05 entitled Emergency Response Cost Recovery Program" consisting of Sections 9.05.010-030, is hereby added to Title 9 of the Baldwin Park Municipal Code to read as follows: Section 9.05.010. Definitions A. Expense of an emergency response" means those costs incurred by the City of Baldwin Park in making an appropriate emergency response to the incident, and shall be comprised of all costs directly arising because of the response to the particular incident, including, but not limited to the costs of providing police services at the scene of the incident, as well as the salaries of the personnel responding to the incident. Section 9.05.020. Emergency Response Cost Recovery program Pursuant to the authority vested in the City of Baldwin Park by state statute, each person who is under the influence of an alcoholic beverage or drug, or the combined influence of an alcoholic beverage or drug, whose negligent operation of a motor vehicle caused by that influence proximately causes any incident resulting in an appropriate emergency response, or whose intentionally wrongful criminal act proximately causes any incident resulting in appropriate emergency response, shall pay to said City the expense of such an emergency response. In no event shall a person's liability under this Chapter exceed the maximum allowable under state statute, and all costs assessed pursuant to this Chapter shall reasonably relate to the actual cost of the expense incurred by the City. Section 9.05.030. Collection of Costs The expense of an emergency response shall be charged against the person liable for the expenses under this Chapter. The charge constitutes a debt of that person to the City of Baldwin Park, and is collectible by said City in the same manner as in the case of an obligation under a contract, expressed or implied. Section 2. That the City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. PASSED and APPROVED this 5th day of April 1989. File case with criminal clerk's office. Drop off/pick up any related evidence from crime lab. Return to city.
