HomeMy WebLinkAboutORD 1026ORD 1026pT3(ÌìÀ‰ ORDINANCE NO. 1026 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE BALDWIN PARK MUNICIPAL CODE WITH REFERENCE TO REGULATIONS APPLYING TO PUBLIC PHONES THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the Section 17.16.190 is hereby added to the Baldwin Park Zoning Code, to read as follows: 17.16.190. Public Phones Permitted as Accessory Uses. Public coin-operated telephones hereafter Telephone") shall be permitted as accessory uses on lots classified in any of the C" or I" zones, subject to the following limitations: a) That the area in which a Telephone is located shall be fully lit, to provide adequate security lighting, as approved by the Police Chief;. and b) That the owner and,'or person entitled to occupancy of the lot upon which a Telephone is located, shall be responsible to insure that the Telephone is maintained at all times, in good working order and condition; and c) That each Telephone located in the City, as of the effective date of this subsection, which is inoperative shall be rendered operative or removed within a period of thirty 30) days following the effective date of Section 17.16.190; and d) No Telephone shall be located so that it projects into a public right-of-way or be located so that any person using said Telephone is required to be in a public right-of-way; and e) The maximum number of Telephones permitted on any lot shall be limited as follows: 1) On lots having a lot area of 15,000 square feet or less Two 2) Telephones; and 2) On lots having a lot area of more than 15,000 square feet, but less than ten 10) acres Three 3) Telephones; and 3) On lots having a lot area of ten 10) acres or more Four 4) Telephones; and f) That one sign, *not exceeding four 4) square feet of sign face area shall be permitted to be located upon each lot where a Telephone is located; and the purpose of such a sign shall be to advise by words, letters or symbols the fact that a Telephone is located on the premises; and g) Notwithstanding any other provision of this Code to the contrary, all Telephones which are not in compliance with the provisions of this Section, 17.16.190, as of the effective date of this said Section, shall be made to comply with the provisions of this subdivision within 180 consecutive calendar days from and after the effective date of this Section. That Section 17.16.020 of the Baldwin Park Zoning Code is hereby amended to read as follows: 17.16.020. Limitations on Permitted Uses. Every use permitted pursuant to Chapters 17.18 through 17.26 of Title 17 of this Code shall comply with the provisions of this Chapter, 17.16." SECTION 3. The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law.
