HomeMy WebLinkAboutORD 1031ORD 1031pT3(ÌìÀi ORDINANCE NO. 1031 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING CERTAIN PROVISIONS OF THE BALDWIN PARK MUNICIPAL CODE RELATING TO CONDITIONS OF ISSUANCE OF BUILDING PERMITS THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That Section 15.04.230 of the Baldwin Park Municipal Code is hereby amended to read as follows: 15.04.230. Conditions of Issuance of Building Permits Waiver. The Director of Community Services, upon written application shall waive or defer the application of Article 1 of this Chapter as follows: a) The Director shall waive the application of this article if he finds that because of the location of the property concerned, the terrain or condition of the property that the construction of curbs or gutters or sidewalks or driveway approaches would be impracticable or unnecessary; or b) The Director shall waive the application of this article of he finds that because of the lack of adequate data in regard to street grade, plans or surveys, that the construction of any of the improvements required by this Article are rendered impracticable or unnecessary; or c) The Director shall waive the application of this article if he finds that the construction of any one or more of the improvements required by this Article is included in a budgeted city project, or an existing or proposed assessment district; or d) The Director shall waive the application of this Article if he finds that the location of the property concerned is on a non Select Street System in an industrially zoned area and there is no appreciable existing or projected pedestrian traffic on the street, thus making the construction of sidewalks impracticable; or e) The Director shall defer the application of this Article for a period of not to exceed two 2) years if he finds that the property concerned is located in a redevelopment plan area, and it appears that the said property will be redeveloped, by the construction and installation of new building, structures or uses, within a period of two years." SECTION 2. That Section 15.04.010 through 15.04.130 inclusive, of the Baldwin Park Municipal Code are hereby redesignated, collectively as Article 1, entitled Uniform Building Code", of Chapter 15.04 of the Baldwin Park Municipal Code. SECTION 3. That Section 15.04.290 of the Baldwin Park Municipal Code is hereby renumbered as Section 15.04.135 and is included within Article 1 of Chapter 15.04 of the Baldwin Park Municipal Code. SECTION 4. That Sections 15.04.140 through 15.04.280 are hereby redesignated as Article II of Chapter 15.04 of the Baldwin Park Municipal Code entitled Building Permits. That Section 15.04.130 A is hereby amended to read as follows: Superintendent' means Superintendent of Building Inspection of the City." SECTION 6. That the City Clerk shall certify the adoption hereof and cause this Ordinance to be published in the manner prescribed by law.
