HomeMy WebLinkAboutORD 1045ORD 1045$Í;¢f4À\ORD 1045 OCT 3 1990GUæ‰8 ORDINANCE NO. 1045 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A CHANGE OF ZONE FROM RG, TO RG(PD) ON APPROXIMATELY 83 ACRES; APPLICANT: AMPERT DEVELOPMENT INC.; CASE NO. Z-501; LOCATION: 3920-3926 STEWART AVENUE) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That the owners of certain real property filed an application for a change of zone from RG, Residential Garden to RG(PD), Residential Garden Planned Development Overlay Zone for real property located at 3920-3926 Stewart Avenue, described, more particularly in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and b) That pursuant to the applicable provisions of the Planning and Zoning Law Section 65800 et. seq of the Government Code of the State of California), studies were commenced for the purpose of amending the Zoning Map of the City of Baldwin Park; and a) That a duly noticed public hearing was held upon said matter by the Planning Commission, and based upon the evidence presented, it determined that the public necessity, convenience, and general welfare warranted that it recommend the approval of the reclassification to RG(PD); and d) That the City Council conducted a duly noticed hearing on said matter, and based upon the evidence presented, and each member being familiar with the site, it was determined that the public interest, necessity, convenience, and general welfare warrant the change in zone classification, herein described. SECTION 2. That notwithstanding the provisions of Chapter 17.54 of the Baldwin Park Municipal Code, the Zoning classification of the Property be and is hereby reclassified from zone RG to zone RG(PD). SECTION 3. That the City Council at the time of the public hearing for the above matter, reviewed and considered the proposed Negative Declaration, and Comments relating thereto. That the City Council, based upon its public review, does hereby approve the proposed Negative Declaration, since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 4. That the City Clerk shall certify to the adoption of this ordinance and shall cause a copy of the same to be published in the manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The City Clerk shall file the Negative Declaration of Environmental Impact.
