HomeMy WebLinkAboutORD 1210ORD 1210pT3(Ììó#ORDINANCE NO. 1210 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AMENDING THE PROVISIONS OF SPECIFIC PLAN 01-1 PERTAINING TO DECORATIVE FENCES AND WALLS AND ALLOWING DECORATIVE FENCES AND WALLS WITHIN THE FRONT YARD SETBACK AREAS FOR THE HOMES FACING BADILLO STREET LOTS 1-13) APPLICANT: CITY OF BALDWIN PARK; LOCATION: 14700-14728 BADILLO STREET; CASE NO.: SP 01-1). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine, and declare as follows: a) That the City of Baldwin Park, on behalf of owners of certain real property, has requested an amendment to Specific Plan SP 01-1, located at 14700-14728 Badillo Street, in the City of Baldwin Park, described more particularly in the Applications on file with the Planning Division; and b) That the request sought approval of an amendment to Section 3.1.04, Yard Areas, and Condition Nos. 12 and 22 of Specific Plan SP 01-1 to allow decorative fences and walls within the required yard areas for homes facing Badillo Street Lots 1-13), in what is commonly called the Badillo Street Housing Development by D.C. Corporation, pursuant to Government Code Section 65453; and c) That on June 25, 2003, a duly noticed public hearing was held on said Applications by the Planning Commission, and based upon evidence presented including applicable staff reports and each member of the Commission being familiar with the properties, the Planning Commission recommended that the City Council approve the Specific Plan amendment; and d) That a duly noticed public hearing was held on said Applications by the City Council, and based upon evidence presented including applicable staff reports and each member of the Council being familiar with the properties, it was determined that the facts as required by the Baldwin Park Municipal Code for the granting of such Applications are present and that the Specific Plan amendment should be approved. That the City Council of the City of Baldwin Park does hereby adopt the following amendment to Section 3.1.04, Yard Areas, of Specific Plan SP 01-1, to read as follows: Decorative fences and walls consisting of block, brick, stone, etc.) may be constructed within the required yard areas for all homes. Only wrought iron fencing will be allowed within the front yard areas of those home facing Badillo Street Lots 1-13). Any decorative fencing proposed along Badillo Street shall be uniform in height, design, material utilized, and color and shall be installed within a period of one 1) year. The precise location and design will be subject to approval by the Planning Division. Chain link fencing is prohibited. SECTION 3. That the City Council of the City of Baldwin Park does hereby adopt the following amendments to Condition Nos. 12 and 22 of Specific Plan SP 01-1, to read as follows: 12. Perimeter walls, excluding walls or decorative fencing in the front yard setbacks along Badillo Street, shall be constructed of decorative concrete block i.e. stucco coated with brick cap or tile trim or other treatment) so as to be consistent with and complement the building's architectural style and color. 22. Any proposed wrought iron fencing for front yard areas shall be compatible in height, design, material utilized and color. Said fencing shall be subject to approval by the Planning Division. SECTION 4. That the City Council at the time of the public hearing on the above matter reviewed and considered the proposed Negative Declaration of Environmental Impact. That the City Council, based upon its public review, does hereby find that said Negative Declaration has been prepared and was considered pursuant to the provisions and guidelines of the California Environmental Quality Act, and hereby adopts the Negative Declaration since there is no substantial evidence that the project will have a significant impact on the environment. SECTION 5. The City Clerk shall certify to the adoption of this Ordinance and shall cause a copy of the same to be published in a manner prescribed by law, and shall forward a copy of the same to the Secretary of the Planning Commission. The Secretary of the Planning Commission shall file the Notice of Determination and Negative Declaration of Environmental Impact. PASSED AND APPROVED on this 30th day of July 2003.
