HomeMy WebLinkAbout1963 047 CC RESO1963 047 CC RESO¼òw @|-lRESOLUTION NO. 63-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK CONSENTING TO THE PROPOSED CHANGES IN THE WORK TO BE DONE WITHIN WEST COVINA ASSESSMENT DISTRICT NO. A'll-61-1 WILLOW AVENUE, MORRIS AVENUE, AND OTHER STREETS AND RIGHTS OF WAY) WHEREAS/ the City of West Covina by Resolution No. 2486 adopted October 29, 1962, declared its intention to make certain improvements as described in said resolution and by Resolution No. 2495 adopted November 13, 1962, ordered said work to be done, all pursuant to the Improvement Act of 1911J and WHEREAS, a portion of the proposed lands to be assessed for said improvement and within which improvement will be made in part is within a portion of the City of Baldwin Park; and WHEREAS, The City Council of the City of West Covina proposes to change the work to be done as described in said Resolution No. 2486 by the acquisition of capacity in certain sewer trunk lines 7 and WHEREAS, a copy of the proposed resolution of change has been submitted by the City Council of the City of West Covina to the City Council of Baldwin Park 7 NOW/ THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That said proposed resolution of change relative to West Covina Assessment District No. A"11-61-1 Willow Avenue, Morris Avenue/ and Other Streets and Rights of Way), a copy of which said resolution marked Exhibit A" is attached hereto and by this reference made a part hereof the same as though set forth in full, hereby is approved; and the City Council of the City of Baldwin Park hereby consents to said proposed change and to the assessment of the costs thereof upon the properties within said City. A certified copy of this resolution shall be forwarded to the City Council of the City of West Covina. SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. A RESOLUTION OF THE CITY COUNCIL OP THE CITY OF WEST COVINA PROPOSING TO CHANGE THE WORK IN ASSESS MENT DISTRICT A-ll-61-1 WILLOW AVENUE, MORRIS AVENUE, AND OTHER STREETS AND RIGHTS OF WAY) WHEREAS, by Resolution No. 2485 of the City Council of the City of West Covina adopted October 29, 1962, the City Council of said City declared its intention to do the work described in said resolution in accordance with Plan No, SP-234 adopted by Resolution No. 2424 of said City Council and Specification No, A'11-61-1 adopted by said Resolution No, 2424; and WHEREAS, no reference was made in said plan or specification or in said Resolution of Intention to the acquisition of capacity in or the right to use sewage disposal facilities; and WHEREAS^ the City Engineer of said City has advised said City Council that it is necessary and advisable to acquire sewer capacity in connection with the Improvements described in said Resolution No. 2485; and WHEREAS, the City Council has deemed It advisable to propose such changes; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES RESOLVE AS FOLLOWS: SECTION 1. The said City Council proposes to change the work described In said plan and specification and the work described and set forth in Resolution No. 2486 as hereinafter set forth. Said work and the things to be done as described in said Resolution No. 2486 are proposed to be changed by the acquisition of capacity rights in certain sewer trunk lines as follows: A) That certain sewer trunk line located in Willow Avenue between the Walnut Creek Wash and the San Bernardino freeway; BIB] 38212-U01 1963-U02 047-U02 CC-U02 RESO-U02 LI3-U03 FO19677-U03 FO50956-U03 DO51019-U03 C6-U03 RESO-U03 8/12/2004-U04 ROBIN-U04 1963 047 CC RESO¼òw @|-lB) That certain sewer trunk line located in Badlllo Avenue between Puente Avenue and the west City boundary of said City; all as shown on Plan No. A'll-Sl-l-A, which plan hereby is approved and adopted by said City Council. Said plan now is on file in the office of the City Engineer and shall be and is open and available for inspection. It is estimated that the proposed changes in the work to be done will Increase the cost of the work by the sum of $7.178.33. SECTION 2. Notice hereby is given that on the day of 1963, at 8:00 p. m. any person interested in the proceedings referred to in said Resolution No. 2486 and having any objections to the changes proposed herein may appear before said City Council and show cause why said changes should not be ordered, and any person interested may file written objections to the proposed changes with the City Clerk at any time not later than the date of the hearing. The City Clerk hereby is directed to publish this resolution in the West Covlna Tribune" at least once, the first publication to be at least ten 10) days prior to the date of the above hear- ing. SECTION 3. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect. APPROVED and ADOPTED this day of 1963.
