RESOLUTION NO. 65-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK MAKING FINDINGS AND OVERRULING PROTESTS AND OBJECTIONS AND CONFIRMING THE REPORT OF SUPERINTENDENT OF STREETS AND THE ASSESSMENT AGAINST THE PROPERTY THEREIN DESCRIBED WHICH FRONTS UPON THE IMPROVE- MENTS SO CONSTRUCTED; CONSTITUTING THE SPECIAL ASSESSMENT A LIEN UPON THE PROPERTY; ORDERING THE COST OF THE WORK TO BE ENTERED IN THE CURRENT ASSESSMENT ROLL AND ESTABLISHING AN INTEREST RATE ON ALL UNPAID ASSESSMENTS. WHEREAS,, pursuant to Division 1, Part 5, Chapter 27 of the Streets and Highways Code of the State of California, the Superintendent of Streets of the City of Baldwin Park did find that the property herein described was on a block" as defined by this part of the Code upon which 50% or more of the front- age thereon had completed curbs, sidewalks, or pavement; and WHEREAS, the Council of the City of Baldwin Park pursuant to the above findings of the Superintendent of Streets and the Division, Part and Chapter of the aforementioned Code did cause Notice to be given to the owner or possessor of the property that curbs, sidewalks, or pavement that were not constructed should be constructed or caused to be constructed by the owner or person in possession of the property fronting on that portion of the street where none had been constructed; and WHEREAS, the above notice also provided for a hearing of objections and protests to the curbs, sidewalks, or pavement that were ordered to be con- structed; and WHEREAS, such a hearing was held on the 15th day of October i9^ p and by Resolution No, 62-188 j protests and objections, if any, were overruled, and the Council ordered the Superintendent of Streets to do the work ordered to be done if the owner or possessor of the property did not con- struct or cause to be constructed, the curbs, sidewalks, or pavement ordered to be constructed within sixty 60) days; and WHEREAS^ after sixty days after the passage and adoption of the above resolution, the work had not been completed by the owner or possessor of the property, the Superintendent of Streets did the work ordered to be done; and BIB] 38212-U01 1963-U02 054-U02 CC-U02 RESO-U02 LI3-U03 FO19677-U03 FO50956-U03 DO51026-U03 C6-U03 RESO-U03 8/12/2004-U04 ROBIN-U04 1963 054 CC RESO¼òw @|-~WHEREAS, on the 8th day of April____^ 19 63 e Superintendent of Street's did file with the Council of the City of Baldwin Park his report of the work he performed in front of the hereinafter described prop- erty pursuant to the aforesaid resolution; and WHEREAS, the Council of the City of Baldwin Park did adopt its Resolu- tion No. 63-46 on the 17th day of APril____________, 19 63 setting a hearing date for any protests or objections to the report of the work of the Superintendent of streets; and WHEREAS, a hearing was held pursuant to the above resolution on the lst day of May 19 63 and no objections or protests were received; NW, THEREFORE, BE IT RESOLVED by the Council of the City of Baldwin Park as follows: Section 1. All protests and objections to the Report of the Super- intendent of Streets and the amount of assessment are hereby overruled. Section 2. The Report of the work of the Superintendent of Streets filed with the Council of the City of Baldwin Park on the 8th day of April 19 63 Is hereby confirmed, which Report is as follows: THE REPORT OF THE SUPERINTENDENT OF STREETS OF WORK COMPLETED PURSUANT TO RESOLUTION NUMBER 62-188 PURSUANT to Resolution Number 62-188 the follow- ing described improvements have been completed: 66 Feet Curb and Gutter Installed The cost of construction was as follows: $___* The description of the real property In front of which this Improve- ment has been constructed is as follows: The southeasterly 74.24 feet of the southwesterly 66 feet of the northeasterly 150 feet of Lot 130, Tract No. 962, as shown on map recorded in Book 21, pages 74 and 75, of Maps, in the office of the Recorder of the County of Los Angeles. 3777 Vineland The Assessment assigned against this property by the Superintendent of Streets Is S 133.70 mu Superintendent of Streets 2- BIB] 38212-U01 1963-U02 054-U02 CC-U02 RESO-U02 LI3-U03 FO19677-U03 FO50956-U03 DO51026-U03 C6-U03 RESO-U03 8/12/2004-U04 ROBIN-U04 1963 054 CC RESO¼òw @|-~Section 5. The cost of the construction of the Report of the Super- intendent of Streets shaN be assessed against the property therein described which property fronts upon the improvement so constructed, Section 4. if such assessment is not paid within five days from the passage and adoption of this Resolution confirming the Report of the work of the Superintendent of Streets, it shall constitute a special assessment against the property herein described, and shall be a lien upon the prop- erty for the amount thereof from the time of recordation of the Notice of Lien, which lien shall continue until frhe assessment and all interest there- on is paid, or until It ifi discharged of record. Section 5. If the assessment is not paid within the above mentioned five days, the City Clerk shall deliver a Notice of Lien signed by the Super- intendent of Streets, substantially the same as that provided for by Section 5891, Chapter 27, of Part 4, Division 7 of the Streets and Highways Code of the State of California to the County Auditor who, in accordance with Section 5895 of the same Chapter, Part and Division of the above Code is required to enter the amount thereof on the County Assessment Book opposite the description of the particular property, and, in accordance with the above section, collect this amount together with all other taxes thereon against the property, Section 6, In addition to the above Notice of Lien, the City Cierk is directed to file with the County Auditor, County Assessor and Tax Collector, certified copies of this resolution and the Report herein adopted, together with a statement endorsed thereon over his signature that this resolution has been adopted by the Council of the City of Baldwin Park, and that the Auditor shall enter the amount of the cost of the work against the property described in the resolution as it appears upon the current assessment roll, Section 7o An interest rate of six per cent per annum is hereby fixed as the rate of interest to be paid to the City of Baldwin Park for the cost of the work until such cost is repaid by the owner either directly or by the tax assessment. Section 8.
