Home My WebLink About1963 107 CC RESO1963 107 CC RESO¼òw @|,±%/ / RESOLUTION NO, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK FINDING AND DETERMINING THAT THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY REQUIRE THE ACQUISITION OF CERTAIN RIGHTS-OF- WAY FOR PUBLIC SEWER PURPOSES AND ALL USES APPURTENANT THERETO. 61-A-l; SEVENTH GROUP) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare that the public interest, convenience and necessity require the acqui- sition by the City of Baldwin Park of rights-of-way over certain hereinafter described real property for public eewer purposes and all uses appurtenant thereto. That the location of said rights-of-way have been planned and located in a manner which will be most compatible with the greatest public good and the least private injury. SECTION 2. That the City Council of the City of Baldwin Park does hereby find, determine and declare that it is the intention of said City of Baldwin Park to acquire in its name the rights-of-way in, over, under, along and across said hereinafter described real property by a proceeding in condem- nation in accordance with the provisions of the Code of Civil Procedure of the State of California. SECTION 3. That said rights-of-way, hereinabove referred to, and the nature thereof, the acquisition of which is required by said public interest, convenience and necessity for the purposes set forth in SECTION I hereof, are located in the City of Baldwin Park, County of Los Angeles, State of California, and are more particularly described on that certain document attached hereto marked Exhibit A", and incorporated herein by this reference. SECTION 4. That the City Attorney of the City of Baldwin Park is hereby authorized and directed to prepares institute and prosecute, in the name of the City of Baldwin Park, such proceedings, in the proper court having jurisdiction thereof, as may be necessary for the acquisition of said rights- of-way in, over, under, along and across the said real property described in SECTION 3 hereof. Said City Attorney is also directed to obtain the necessary Order of court granting to the City of Baldwin Park the right of immediate occupancy and posses sion of said rights-of-way. SECTION 5. The City Clerk shall certify to the adoption of this resolution, 1363.
