A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DISAPPROVING A
TENTATIVE TRACT MAP FOR TRACT NO, 28820
EMERALD STATES OWNER. STRECKER ASSOCIATES,
INC.. ENGINEERS).
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK
DOES RESOLVE AS FOLLOWS;
SECTION 1. That the City Council of the City
of Baldwin Park does hereby find, determine and declare
as follows?
a) That a tentative subdivision map for
Tract NO. 28b20 has heretofore been filed with the City;
and
b) That said proposed subdivision includes
portions of Lots 5 and 6 of Tract No. 1605 as recorded
in Book No. at Page of Official Records on file
in the office of the Recorder of said County of Los
Angeles? and
c) That said proposed tentative tract map
has been considered by the Planning Commission of the
City, which Commission, by its resolution number PC-63-
144 has heretofore recommended approval of said tenta-
tive tract map to the City Council? and
d) That the City Council duly considered the
said tract map together with the planning Commission's
recommendations and staff reports relating thereto, at"
its regular meeting on October 2, 1963; and
e) It appears that the real property pro-
posed to be suodivided in the manner as shown on the
said proposed tentative tract map was included within
the provisions of Ordinance No. 241 of the City of
Baldwin Park, which ordinance purported to rezone this
and other real property as described therein; and
f) That said Ordinance NO. 241 was the sub-
ject of a referendum petition, and a subsequent refer-
endum election held on August 20, 1963 within said
City of Baldwin Park? and
y) That said Ordinance No. 241, at the time
of said referendum election was defeated by the elec-
torates; and
h) That the properties included within the
said proposed subdivision are presently zoned A-l, and
the development as proposed would of necessity require
rezoning to R-l zone? and
i) Pursuant to the provisions of the Elec-
tions Code of the State of Califorjua relating to

Z P > û8initiatives und referendum matters, the said property
included within thia proposed subdivision cannot be
considered for rescuing for a period of a minimum of
one year on and after the date of August 20, 1963,
said date being the date of the referendum election;
and
j) That it appears that the proposed sub-
division would not comply with the zoning regulations
as contained in the Baldwin Park Municipal Code, and
for that reason the said subdivision map as submitted
must be disapproved„
SECTION 2. That the proposed tentative tract
map for Tract No. 28820, as above described, oe, and
the same hereby is, denied for the reasons hereinabove
set forth.
SECTION 3. That the City Clerk shall certify
the adoption of this resolution and forward copies
hereof to the Secretary of the Planning Commission and
to the applicant.
