A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BALWIN PARK DETEBMIlttKG THAT THERE^IS. ONLY
ONE CONTRACTOR CAPABLE Of SERVING THE STREET
LIGHTING SYSTEM WITHIN BALDWIN PARK STREET
LIGHTING DISTRICT, IN ACCORDANCE WITH
DIAGRAM AND PLAN. AND ORDERING THE IMPROVEMENT
TO BE CARRIED OUT BY SUCH CONTRACTOR
WHEREAS^ the Baldwin Park Lighting District has been
created and established pursuant to the provisions of the Street
Lighting Act of 1919; and
WHEREAS, Section 18171 of the Streets and Highways Code
authorizes the City Council Co determine that if there is only one
contractor practically capable of serving the street lighting system
to be improved, in the manner provided in the plans and specifications
contained in the report required by Division 14, Part I, Chapter 3, of
the Streets and Highways Code, proved that such contractor is subject
to the jurisdiction of the Public Utilities Commission of the State
of California,
NOW, THEREFORE. BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BALEWIN PARK, as follows:
SECTION 1. That the City Council of the City of Baldwin Park
finds that the Southern California Edison Company, a corporation, is the
only contractor practically capable of serving the street lighting
system to be improved in the manner provided for in the diagram and
plan contained in the report submitted in these proceedings as required
by Division 14, Part I, Chapter 3 of the Streets and Highways Code.
and that the Southern California Edison Company is subject to the
jursidiction of the Public Utilities Commission of the State of
California.
SECTION 2. That is hereby ordered that the improvement of
the Baldwin Park Lighting District be carried out in accordance with
said diagram and plan by the Southern California Edison Company.
SECTION 3, That it is further ordered and directed that the
Mayor and the City Clerk shall execute and attest to, on behalf of this
City, a contract with the Southern California Edison Company for the
improvement in accordance with diagram and plan of the Baldwin Park
Lighting District pursuant to the provisions of Section 18171 of the
Streets and Highways Code; said improvement shall be carried out in
accordance with rates and rules filed by Southern California Edison
Company, from time to time, with the Public Utilities Commission of
the State of California.
SECTION 4. That it is further ordered that the Southern
California Edison Company shall start construction and installation
of the new street lights that are to be installed in the Baldwin Park
Lighting District in accordance with, and as shown on, the diagram and
plan, and that they endeavor to complete said construction as soon as
is lawful and practical.
