RESOLUTION NO. 66 55
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK MAKING
FINDINGS AND OVERRULING PROTESTS AND
OBJECTIONS AND CONFIRMING THE REPORT
OF SUPERINTENDENT OF STREETS AND THE
ASSESSMENT AGAINST THE PROPERTY THEREIN
DESCRIBED WHICH FRONTS UPON THE IMPROVE-
MENTS SO CONSTRUCTED; CONSTITUTING THE
SPECIAL ASSESSMENT A LIEN UPON THE
PROPERTY; ORDERING THE COST OF THE WORK
TO BE ENTERED IN THE CURRENT ASSESSMENT
ROLL AND ESTABLISHING AN INTEREST RATE
ON ALL UNPAID ASSESSMENTS,
WHEREAS, pursuant to Division 7, Part 3, Chapter 27 of the Streets
and Highways Code of the State of California, the Superintendent of Streets of
the City of Baldwin Park did find that the property herein described was on a
block" as defined by this part of the Code upon which 50% or more of the front-
and gutters

WHEREAS, the Council of the City of Baldwin Park pursuant to the above
findings of the Superintendent of Streets and the Division, Part and Chapter of
the aforementioned Code did cause Notice to be given to the owner or possessor

should be constructed or caused to be constructed by the owner or person In

had been constructed; and
WHEREAS, the above notice also provided for a hearing of objections

WHEREAS, after sixty days after the passage and adoption of the
above resolution, the work had not been completed by the owner or possessor

Superintendent of Streets did file with the Council of the City of Baldwin Park
his report of the work he performed in front of the hereinafter described prop-
erty pursuant to the aforesaid resolution; and
WHEREAS, the Council of the City of Baldwin Park did adopt its Resolu-
tion No. 66-32______ on the 2nd_______ day of February_____________^
19 66 setting a hearing date for any protests or objections to the report of
the work of the Superintendent of streets; and
WHEREAS, a hearing was held pursuant to the above resolution on the
2nd day of March_________, 1966 and objections or
protests were received;
NW, THEREFORE, BE IT RESOLVED by the Council of the City of Baldwin
Park as follows?
Section I. AN protests and objections to the Report of the Super-
intendent of Streets and the amount of assessment are hereby overruled.
Section 2. The Report of the work of the Superintendent of Streets
fi led with the Counci I of the City of Baldwin Park on the 2nd jay of
February 19 66___y is hereby confirmed, which Report is as follows:

COMPLETED PURSUANT TO RESOLUTBON NUMBER 65-159
PURSUANT to Resolution Number 65-159 the follow-
ing described improvements have been completed:
Curbs and gutters

1966 055 CC RESOxJ Õ p Section 5, The cost of the construction of the Report of the Super-
intendent of Streets shall be assessed against the property therein described
which property fronts upon the improvement so constructed,
Section 4, If such assessment ts not paid within five days from
the passage and adoption of this Resolution confirming the Report of the work
of the Superintendent of Streets, it shall constitute a special assessment
against the property herein described, and shall be a lien upon the prop-
erty for the amount thereof from the time of recordation of the Notice of
Lien, which lien shall continue until the assessment and all interest there-
on is paid, or untii it is discharged of record,
Section 5. f the assessment is not paid within the above mentioned
five days, the City Clerk shall deliver a Notice of Lien signed by the Super-
intendent of Streets, substantially the same as that provided for by Section
5891, Chapter 27, of Part 4, Division 7 of the Streets and Highways Code of
the State of California to the County Auditor who, in accordance with Section
5893 of the same Chapter, Part and Division of the above Code is required to
enter the amount thereof on the County Assessment Book opposite the description
of the particular property, and, in accordance with the above section, col Sect
this amount together with all other taxes thereon against the property,
Section 6, In addition to the above Notice of Lien, the City CBerk
is directed to file with the County Auditor, County Assessor and Tax Collector,
certified copies of this resolution and the Report herein adopted, together with
a statement endorsed thereon over his signature that this resolution has been
adopted by the Council of the City of Baldwin Park, and that the Auditor shall
enter the amount of the cost of the work against the property described in
the resolution as it appears upon the current assessment rollo
Section 7 a An interest rate of six per cent per annum is hereby
fixed as the rate of interest to be paid to the City of Baldwin Park for the
cost of the work until such cost is repaid by the owner either directly or by
the tax assessment.
Section 8, The Clerk shall certify to the passage and adoption of
this resolution and it shall thereupon take effect and be in force.
