A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK DENYING A
CONDITIONAL USE PERMIT APPLICATION.
APPLICANT: OALEWOOO PROPERTIES;
CASE NO. CP-72)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:
SECTION I. That the City Council of the City of Baldwin Park does
hereby find and determine es follows:
a) That on February 9, 1966, the Board of Zoning Adjustments
held a duly noticed public hearing on an application for a
Conditional Use Permit to allow the construction and use of
an automobile service station on certain hereafter described
real property; and
b» That the property to which said Conditional Use Permit applica-
tion relates Is located at 14600 Dalewood Street, in the City
of Baldwin Park, County of Los Angeles, State of California,
more particularly described as:
The northerly 125 feet, measured at right angles, of Lot
50 of El Monte Walnut Place, in the City of Baldwin Park,
In the State of California, as per map recorded in Book
6, page 104 of Mops, in the office of the County Recorder
of said County; and
c) That the Conditional Use Permit is required for the construction
and use of service stations as specified by the Municipal Code,
Section 9472, subsection 23; and
d) That the Board of Zoning Adjustments found that the facts re-
quired by Section 9475 of the Baldwin Park Zoning Code, are not
present; and
e) That an appeal from that decision was duly taken, and the Counci
conducted a duly noticed public hearing on said appeal, and,
based upon the evidence presented, and each member of the Counci
being familiar with the site, said Council found that the facts
required by Section 9475 of the said Code, were not present, in
that the subject property is directly adjacent to a developed
residential zone located in the City of West Covina, and if
this use were permitted it would have a definite adverse effect
upon such properties; in addition, the street pattern, and
vehicular access is insufficient for the proposed use, in
view of other developments in the immediate area.
SECTION 2. That the Conditional Use Permit, above described, be, and
the same hereby is denied, for the following reasons:
a) That the facts required by Section 9475 of the Baldwin Park
Municipal Code are not present-
b) That the proposed use will not be compatible with and will
have an adverse effect upon abutting and adjacent properties,
for the reasons above set forth,
SECTION 5. That the City Clerk shall certify to the adoption of this
resolution and forward a copy hereof to the applicant and the Secretary of
the Board of Zoning Adjustments.
ADOPTED AND APPROVED this 6th day of_____April_____, 1966.
