RESOLUTION NO. 66-102
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK MAKING
FINDINGS AND OVERRULING PROTESTS AND
OBJECTIONS AND CONFIRMING THE REPORT
OF SUPERINTENDENT OF STREETS AND THE
ASSESSMENT AGAINST THE PROPERTY THEREIN
DESCRIBED WHICH FRONTS UPON THE IMPROVE-
MENTS SO CONSTRUCTED; CONSTITUTING THE
SPECIAL ASSESSMENT A LIEN UPON THE
PROPERTY; ORDERING THE COST OF THE WORK
TO BE ENTERED IN THE CURRENT ASSESSMENT
ROLL AND ESTABLISHING AN INTEREST RATE
ON ALL UNPAID ASSESSMENTS,
WHEREAS,, pursuant to Division 7, Part 5, Chapter 27 of the Streets
and Highways Code of the State of California, the Superintendent of Streets of
the City of Baldwin Park did find that the property herein described was on a
block" as defined by this part of the Code upon which 50% or more of the front-
age thereon had completed curbs, sidewalks, or pavement; and
WHEREAS, the Council of the City of Baldwin Park pursuant to the above
findings of the Superintendent of Streets and the Division, Part and Chapter of
the aforementioned Code did cause Notice to be given to the owner or possessor
of the property that curbs, sidewalks, or pavement that were not constructed
should be constructed or caused to be constructed by the owner or person in
possession of the property fronting on that portion of the street where none
had been constructed; and
WHEREAS, the above notice atso provided for a hearing of objections
and protests to the curbs, sidewalks, or pavement that were ordered to be con-
structed; and
WHEREAS, such a hearing was held on the Isf. day of December____,
19 j. and by Resolution No, 65-188 ati protests and objections, if any, were
overruled, and the Council ordered the Superintendent of Streets to do the work
ordered to be done if the owner or possessor of the property did not con-
struct or cause to be constructed, the curbs, sidewalks, or pavement ordered to
be constructed within sixty 60) days; and
WHEREAS, after sixty days after the passage and adoption of the
above resolution, the work had not been completed by the owner or possessor
of the property, the Superintendent of Streets did the work ordered to be
done; and

Superintendent of Streets did file with the Council of the City of Baldwin Park
his report of the work he performed in front of the hereinafter described prop-
erty pursuant to the aforesaid resolution; and
WHEREAS, the Council of the City of Baldwin Park did adopt its Resolu-
tion No. 66 69_____ on the 16th____ day of March_____________^
19 66 j. setting a hearing date for any protests or objections to the report of
the work of the Superintendent of streets; and
WHEREAS, a hearing was held pursuant to the above resolution on the
20th day of AprU________, 19 66 and 0____ objections or
protests were received;
NCW, THEREFORE, BE IT RESOLVED by the Council of the City of Baldwin
Park as follows:
Section I. All protests and objections to the Report of the Super-
intendent of Streets and the amount of assessment are hereby overruled.
Section 2. The Report of the work of the Superintendent of Streets
filed with the Council of the City of Baldwin Park on the l6th day of
March_______, 19 66 Is hereby confirmed, which Report Is as follows:

COMPLETED PURSUANT TO RESOLUTION NUMBER 6^188
PURSUANT to Resolution Number 6q-l88 the follow-
ing described improvements have been completed:

1966 102 CC RESOxJ Ö 6 Section 5, The cost of the construction of the Report of the Super-
intendent of Streets snail be assessed against the property therein described
which property fronts upon the improvement so constructed,
Section 4, If such assessment Is not paid within five days from
the passage and adoption of this Resolution confirming the Report of the work
of the Superintendent of Streets, it shalt constitute a special assessment
against the property herein described, and shati be a lien upon the prop-
erty for the amount thereof from the time of recordation of the Notice of
Lien, which lien shall continue until frhe assessment and all interest there-
on is paid, or untiS it is discharged of record.
Section 5. H the assessment is not paid within the above mentioned
five days, the City Clerk shall deliver a Notice of Lien signed by the Super-
intendent of Streets, substantially the same as that provided for by Section
5891, Chapter 27, of Part 4, Division 7 of the Streets and Highways Code of
the State of California to the County Auditor who, in accordance with Section
5895 of the same Chapter, Part and Division of the above Code is required to
enter the amount thereof on the County Assessment Book opposite the description
of the particular property, and. In accordance with the above section, collect
this amount together with all other taxes thereon against the property,
Section 6, In addition to the above Notice of Lien, the City Cierk
is directed to file with the County Auditor, County Assessor and Tax Collector,
certified copies of this resolution and the Report herein adopted, together with
a statement endorsed thereon over his signature that this resolution has been
adopted by the Council of the City of Baldwin Park, and that the Auditor shall
enter the amount of the cost of the work against the property described in
the resolution as it appears upon the current assessment roll,
Section 7, An interest rate of six per cent per annum is hereby
fixed as the rate of interest to be paid to the City of Baldwin Park for the
cost of the work until such cost is repaid by the owner either directly or by
the tax assessment.
Section 8. The Clerk shall certify to the passage and adoption of
this resolution and it shall thereupon take effect and be in force,

Pursuant to the authority vested in aie by the
IMPROVEKENF ACT of 1911, I did, on the y^^-day of_^^^_,

the legislative body of said city did, on the 20th day of

assess the cost of such construction upon the real property
hereinafter described, and the same has not been paid nor any
part thereof, and the said city, does hereby claim a lien on
said real proper ty in the sum of FOUR HUNDRED NINETY TWO DOLLARS
AND FIFTY CENTS___________________($ 492.50____________), and the
same shall be a lien upon said real property until the said
sum, with interest at the rate of six percent per annum,
