RESOLUTION OF INTENTION
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK,
CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE CONSTRUCTION
AND IMPROVEMENT OF;
JERRY AVENUE from the center line of Ohio Street southerly
859 feet and construction of sanitary and storm sewers In an
easement between Jerry Avenue and Merced Avenue and con-
struction of storm sewer in Merced Avenue from 562.88 feet
north of the center line of Los Angeles Street to U9h»66 feet
north of the center line of lLos Angeles Street; and con-
struction of curb returns and paving within the intersection
of Ohio Street and Jerry Avenue.
BY THE ACQUISITION OF CERTAIN RIGHTS-OF-WAY» AND,
BY THE INSTALLATION AND CONSTRUCTION OF:
1. Curbs;
2. Gutters;
5. Sidewalks;
h* Driveway approaches;
5. Street paving;
6. Utilities;
7. Street lights;
8. Sanitary sewers;
9. Storm sewers;
10. Right-of-way acquisition; and
11. All appurtenant work.
ALL IN THE MANNER, MEANS AND TO THE EXTENT SHOWN ON MAP ON FILE
IN THE OFFICE OF THE CITY ENGINEER ENTITLED MAP OF JERRY AVENUE
ASSESSMENT DISTRICT A/D 66-1) DECLARING THE WORK TO BE OF MORE
THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND DESCRIBING THE
DISTRICT TO BE BENEFITTED BY SAID WORK AND TO PAY THE COSTS
AND EXPENSES AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS
TO SAID WORK.
The City Council of the City of Baldwin Park, pursuant
to the provisions of the Improvement Act of 1911"» being
Division 7 of the Streets and Highways Code of the State of
California, does resolve as follows;
DESCRIPTION OF WORK
SECTION I. That the public interest and convenience
require, and it is the intention of the City Council of the
City of Baldwin Park, California, to order the following work
to be done, to wit;

SECTION 1-A, The p'.iblic interest, necessity and con-
venience require the acquisition of the to 1 lowing described
property and to assess the costs and incidental expenses thereof
as a part of the work and improvement of said Assessment District

SECTION 2. All of the said acquisition work and im-
provements to be done shall be constructed upon the grades,
along the lines, between the points, of the dimensions, at the
places and in the manner shown on the plans, profiles and
drawings for;

of curb returns and paving within the
Intersection of Ohio Street and Jerry
Avenues
and In the district benefltting thereby, all known as Jerry
Avenue Assessment District, as approved by Resolution No, 66-115,
on file In the Office of the City Engineer of said City, and
except as otherwise provided on said plans. In further accordance
with the specifications for the construction of said Improvements,
said specifications being on file In the Office of the City Clerk
of said City, and to which plans, profiles, drawings and specifi-
cations heretofore approved by the City Council of said City
reference is hereby made for a further, full and more particular
description of said work, end they shall govern as to all details.
DESCRIPTION OF ASSESSMENT DISTRICT
SECTION 5. That the said contemplated work and Im-
provement, in the opinion of said City Council, is of more than
local or ordinary public benefit, and the said City Council hereby
makes the expenses of the said work and improvement chargeable
upon a district, which said district the said City Council hereby
declares to be the district benefited by said work and Improvement
and to be assessed to pay the costs and expenses thereof, and
which district is described as followsx
All that certain territory of the City of Baldwin Park,
California, exclusive of streets and alleys. Included within the
exterior boundary line shown upon that certain map or plat for
Jerry Avenue Assessment District A/^) 66-1), heretofore approved
by the City Council of said City, Indicating by said boundary
tine the extent of the territory Included within the proposed
assessment district, and which map or plat Is on file in the
Off Tee of the City Engineer of said City. Reference Is hereby
made to said map or plat for a further, full and more particular
description of seld assessment district, and the said map or plat
so on file shall govern for all details as to the extent of the
said aas^sswent district.
DESCRIPTION OF BONDS
SECTION h^ Serial bonds, bearing Interest at the rate
of six per cent 6^) per annum, shall be Issued to represent e-ach
assessment of Fifty Dollars $50,00) or more, remaining unpaid
for thirty 50) days after the due date as set forth Tn Section
5590 of the Streets and Highways Code. Said serial bonds shall
extend over a period ending nine 9) years from the second day of
January next succeeding the next September first following their
date» Payments on the principal of unpaid asse&sments and interest
thereon shall be made by property owners to the City Treasurer, and
the same shall be disbursed by said City Treasurer, all as provided
tn the tt Improvement Act of 19N"» herein referred to,
TIME AND PLACE OF HEARING
SECTION 5. NOTICE IS HEREBY GIVEN, that on the 1st day
of June, 1966, at the hour of eight o^tock P.M, In the Council
Chambers of the City Council in the City Hall at 114+05 East
Pacific Avenue, In said City of Baldwin Park, any and all persons
having any objections to the proposed work or improvement or to
the extent of the assessment district, or to the proposed grades,
may appear and show cause why said work should not be done or
carried out or why said district should not be formed n accordance

must be delivered to the City Clerk prior to the time set for
the hearing, and must identify the protesting property, all as
set forth In said Improvement Act of 1911".
ESTIMATED COSTS
SECTION 6, The City Engineer has estimated the costs
of such work and improvement at $45»696,20{ and the cost of mi see
laneous incidental expenses as authorized by the Improvement Act
of 1911" and cost of these proceedings at $29,590.25, for a total
cost of $75.286.145.
DEBT LIMIT PROCEEDINGS
SECTION 7. These proceedings have been instigated by
a petition signed by the owners of more than sixty per cent 60?S)
of the area of said district; based upon such petition, the City
Council has initiated these proceedings, without the procedures
of Division U of the Streets and Highways Code,
SECTION 510^ WORK
SECTION 8. The City Council determines that the public
interest requires and It will be more economical to do certain
limited corrective work on private property to the extent author-
ized by Section 5*°^- o^ t^® Streets and Highways Code.
NO PRIVATE CONTRACT
SECTION 9. In accordance with Section 5260 of said
Streets and Highways Code, the City Council hereby determines
that the public Interest will not be served by allowing the
property owners to make any of such improvements, and according
ly any and all private contracts for such work are prohibited.
SPECIFICATION DETAIL
SECTION 10, The structures, work and improvements
described herein shall be constructed to the grades, subgrades
and elevations severally shown upon the plans and profiles and
detailed drawings thereof In the respective locations thereof,
to which plans and profiles reference Is hereby expressly made
for a description of the grades to which all of the work and Im-
provements under this Resolution of Intention shall be done,
which said grades are hereby adopted and established as the
official grades therefor for all purposes in connection with
proceedings pursuant to this Resolution of Intention; notice Is
hereby further given that said grades are or may be, in part,
new and different from existing ground levels;
The plans and specifications, profiles and detailed
drawings and diagrams accompanying the same, are hereby expressly
referred to for full and detailed description and location of
said proposed acquisition, work, and improvements, the public
streets and rights-of-way involved, and the grades of the public
streets and rights-of-way Involved, and of the grades to which
said Improvements are to be constructed;

There shall be excepted from all of the herein described
work all of said work that has already been done to the lines and
grades shown on said plans and profiles, and In accordance with
said plans and specifications;
All of said work shall Include, without duplication, any
and all streets. Intersections^ terminations and opposite termi-
nation occurring within the limitations of said work; and
All of said classes of work above described may not be
constructed upon all of the streets and/or public ways above de^
scribed In their entirety, but only upon the particular locations
as shown on the plans and specifications.
IMPROVEMENT ACT OF 19*
SECTION N. All of the work herein proposed shall be
done and carried through In pursuance of an Act of the Legis"
lature of the State of California, designated the Improvement
Act of 1911" being Division 7 of the Streets and Highways Code
of the State of California.
PUBLICATION OF RESOUJTION OF INTENTION
SECTION 12. The Baldwin Park Bulletin, a newspaper
printed, published and of general circulation In the City of
Baldwin Park, California, Is hereby designated as the newspaper
n which this Resolution of Intention shall be published by the
City Clerk In the manner and form provided by law.
MAILING OF NOTICE
SECTION 15. The City Clerk is directed to mail notices
of the adoption of this Resolution of Intention to all persons
owning real property proposed to be assessed In these proceedings,
whose names and addresses appear on the last equalized assessment
roll for taxes, all In the manner and form provided for under
Sections 5070, 519^. 5195 and 5197 of the said Improvement Act
of 1911"» of said Streets and Highways Code.
POSTING OF NOTICE OF IMPROVEMENT
SECTION ll^ The Superintendent of Streets of the City
of Baldwin Park, California, shall cause to be conspicuously
posted along the line of said contemplated work or Improvement
and along all open streets within the district liable to be
assessed for said work, notices of the passage of this Resolution
of Intention in the time, form and manner provided by said
Streets and Highways Code.
SECTION 15. The City Clerk shall certify to the
passage and adoption of this Resolution and It shall thereupon
take effect and be In force.
APPROVED and ADOPTED this lith day of May, 1966.
