A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK GRANT-
ING A ZONE VARIANCE APPLICANT:
RICHFIELD OIL CORPORATION; CASE
NO. ZV-150)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:
SECTION I. That the City Council of the City of Baldwin Park does hereby
find, determine and declare as follows:
a) That the owners of certain real property located at 13011 East
Garvey Avenue in said City, which is more particularly described on the
application herein on file, heretofore applied for a zone variance to per-
mit a free-standing sign, in conjunction with a service station use, in
excess of the height and sign face limitations imposed by the Baldwin Park
Municipal Code; and
b) That the Board of Zoning Adjustment conducted a duly noticed
public hearing upon said matter, and based upon the evidence' so presented,
determined that the facts required by Section 9471 of the said Code were
not present and denied the said application; and
c) That thereafter a timely appeal was filed, appealing the Board's
decision to the City Council; and
d) That a duly noticed public hearing was held upon said appeal,
and based upon the evidence presented, it was determined that the facts
required by Section 9471 of said Code were, in fact, present end that the
application should be granted upon the terms and conditions hereinafter
set forth.
SECTION 2. That the above described zone variance be, and the same hereby
is, approved, subject to the following terms and conditions:
a) That the overall sign height shall not exceed the total of 45
feet, measured from the finished grade of the subject property; and
b) That the total overall sign face area shall not exceed 269.50
square feet; and
c) That the lighting of the said sign, shall be so defused so as
not to constitute a nuisance to surrounding and adjacent properties; and
d) That the said construction shall, except as hereinabove pro-
vided, comply with the plot plan as submitted and approved; and
e) That compliance shall be had with all other applicable sec-
tions of the Baldwin Park Municipal Code.
SECTION 3. That the City Clerk shall certify the adoption of the Reso-
lution and forward a copy hereof to the Secretary to the Board of Zoning
Adjustment and to the applicant.
