A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK GRANTING A
ZONE VARIANCE APPLICANT: AMERICAN
OIL COMPANY; CASE NO. ZV-156)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park does hereby
find, determine and declare as follows:
a) That the owners of certain real property have heretofore filed
an application for a zone variance to permit the use of an on-site free-
standing sign, in connection with a service station use, in excess of the
maximum sign face area and height limitation as permitted by the Baldwin
Park Municipal Code; and
b) That the property to which this said variance relates is
located at 13755 Francisquito Avenue in the City of Baldwin Park, and is
more particularly described on the application for said variance on file
with the Secretary of the Board of Zoning Adjustment; and
c) That the Board of Zoning Adjustment conducted a duly noticed
public hearing upon said application and thereafter, granted the same
upon certain terms and conditions as set forth in the said Board's res-
olution BZA 66-22; and
d) That the applicant filed a timely notice of appeal, appealing
the decision of the Board to the City Council; and
e) That the City Council conducted a duly noticed public hearing
upon said appeal and thereafter determined that the facts required by
Section 9471 of the Baldwin Park Municipal Code were present, and that
the variance application should be granted upon certain terms and con-
ditions as hereinafter set forth.
SECTION 2. That the above described variance is approved, subject to
the following terms and conditions:
a) That the proposed free-standing sign shall be permitted pro-
viding that the maximum overall height of the same shall not exceed 60
feet, measured from the finished grade of the subject property; and
b) That the total gross sign face area of said sign shall not
exceed a total of 227.50 square feet; and
c) That said sign and its construction shall comply with Exhibit
A" as approved, except as expressly herein modified; and
d) That the lighting of said sign shall be defused so as not to
constitute a nuisance to surrounding or adjacent properties; and
e) That the construction and maintenance of said sign shall com-
ply with all other provisions of the Baldwin Park Municipal Code.
SECTION 3. That the City Clerk shall certify the adoption of this Res-
olution and forward a copy hereof to the Secretary of the Board of Zoning
Adjustment and to the applicant.
