A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DENYING A ZONE
VARIANCE APPLICATION LOCATION: 3090 N.
MAINE; APPLICANT: SCHAVONI, ET AL;
CASE NO. ZV_1~8)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION I. That the City Council of the City of Baldwin Park
does hereby find and determine as follows:
a) That the Board of Zoning Adjustments held a duly
noticed public hearing on the application for a zone variance to
allow development of property in Zone C-2-A, with less than the
required lot area; and
b) That the property to which said zone variance relates
is located at 3090 N. Maine, in the City of Baldwin Park, County
of Los Angeles, State of California, more particularly described
in the Board's case file; and
c) That the Board determined that the variance should be
granted; and
d) That a timely appeal was taken, appealing the,decision
of the Board to the City Council; and
e) That after conducting a public hearing upon said matter,
and each member of the Council being familiar with the site, the
Council determined that the facts required by Section 9471 of the
Baldwin Park Municipal Code were not present, and that granting
said variance would adversely affect the General Plan, and adjacent
and surrounding properties.
SECTION 2. That the variance application above referred to is hereby
denied, based on the findings as follows:
a) That the proposed use will not be compatible with, and
will have an adverse effect upon abutting and adjacent properties
located in the City of Baldwin Park; and
b) That the proposed use would not be in keeping with the
General Plan for land use in this area; and
c) That the facts required by Section 9471 of the Baldwin
Park Municipal Code were not present.
SECTION 3. That the City Clerk shall certify to the adoption hereof,
and forward a certified copy of this resolution to the applicant and to the
Secretary of the Board of Zoning Adjustments.
APPROVED and ADOPTED this 19th day of October 1966.
