APPLICANT: R. CASPERSON, ET AL. CASE NO. Z-296 THE CITY COUNCIL OF THE CITY OF BALDININ PARK DOES HEREBY RESOLVE AS FOLLOk'IS: SECTION I. That the City Council of the City of Baldwin Park does hereby find and determine as follows: a. That on the 28th day of September, 1966, the Commission held a duly noticed public hearing on the application for a change of zone from Zone R-I single family residential) to Zone C-1 neighborhood commercial) on certain here- after described property. b. That the property to which said zone change relates is located at 13629 Francisquito Avenue and 3109 Maine Avenue, in the City of Baldwin Park, County of Los Angeles, State of California, more particularly described as: That part of Rancho La Puente beginning at a point where the NE line of Francisquito Avenue intersects with the NN line of Maine Avenue, thence M^1 along said NE line to intersect with a line parallel to and 278 feet SE of the centerline of Baldwin Park Blvd.; thence NE along said parallel line 120 feet; thence SE parallel to said NE line of Francisquito Avenue to the MV line of Maine Avenue; thence SW along said MV line 120 feet to the point of beginning. c. That the application was denied by the Planning Commission; and d. That a timely appeal was filed, and after a public hearing thereon, the City Council determined that the public interest required that the said be denied. SECTION 2. That the change of zone from Zone R-I to Zone C-I as above described, is hereby denied', based on the findings as follows: a. That the proposed use will not be compatible with, and will have an adverse effect upon, abutting and adjacent properties located in the City of Baldwin Park; and b. That the proposed use would not be in keeping with the General Plan for land use in this area. c. That the proposed reclassification would create spot zoning of an area which would not benefit the community as a whole. SECTION 3. The City Clerk shall certify to the adoption of this resolution and is directed to forward a certified copy to the applicant and the Secretary of the Planning Commission.
