A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK CONFIRMING
THE REPORT OF THE SUPERINTENDENT OF
STREETS 66-S-17)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin Park
does hereby find, determine and declare as follows:
a) That the City Council of the City of Baldwin Park, pursuant
to Section 5870, et seq. of the Streets and Highways Code, commenced
proceedings to cause the construction of certain improvements to wit:
sidewalk and drive approach;
b) That a public hearing was held on said matter, and thereafter,
said City Council ordered said construction to be accomplished; and
c) That sixty 60) days after said order was served, the work
had not been completed by the owner or possessor of the property and the
Superintendent of Streets caused the work to be done; and
d) That the Superintendent of Streets did file with the City
Council of the City of Baldwin Park his report of such work, Resolution
No. 66-280; and
e) That said City Council conducted a noticed hearing to
consider any protests or objections to the Report of the work; and
f) That protests were filed, and allowed, in part, so as to
reduce the proposed assessments, as follows: Parcel 1 $103.00; Parcel
2 $102.00; Parcel 3 $99.88.
SECTION 2. That the Report of the Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
confirmed, as modified.
SECTION 3. That the cost of the construction, as set forth in
said,Report, as modified, shall be assessed against the properties therein
described, which property fronts upon the improvement so constructed.
SECTION 4. That if such assessment is not paid within the time
permitted by law it shall constitute a special assessment and lien against
the property therein described, in the amounts set forth in said Report,
which lien shall continue until the assessment and all interest thereon
is paid.
SECTION 5. That if the assessment is not paid within the time
permitted, the City Clerk shall deliver a Notice of Lien, signed by the
Superintendent of Streets, as provided in Section 5891 of the Streets and
Highways Code of the State of California, to the County Assessor and Tax
Collector, who, in accordance with applicable law, shall collect said
assessment, together with all other taxes relating to such properties.
SECTION 6. That the interest rate of six percent 6%) per annum
is hereby fixed as the rate of interest to be paid to the City upon the
amount due for unpaid assessments.
SECTION 7. That the City Clerk shall certify to the adoption of
this Resolution.
