A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK CONFIRMING THE
REPORT OF THE SUPERINTENDENT OF STREETS
66-S-24)
The City Council of the City of Baldwin Park does hereby resolve
as follows:
SECTION 1. That the City Council of the City of Baldwin Park does
hereby find, determine and declare as follows:
a) That the City Council of the City of Baldwin Park, pursuant'
to Section 5870 et seq. of the Streets and Highways Code, commenced
proceedings to cause the construction of certain improvements to wit:
curbs and gutters;
b) That a public hearing was held on said matter, and thereafter
said City Council ordered said construction to be accomplished; and
c) That sixty 60) days after said order was served, the work
had not been completed by the owner or possessor of the property and the
Superintendent of Streets caused the work to be done; and
d) That the Superintendent of Streets did file with the City
Council of the City of Baldwin Park his report fo such work, Resolution
No. 66.284; and
e) That said City Council conducted a noticed hearing to consider-
any protests or objections to the Report of the work; and
f) That no protests ere made;
SECTION 2. That the Report of the Work of the Superintendent of
Streets heretofore filed and above described, be and the same is hereby
confirmed.
SECTION 3. That the cost of the construction, as set.forth in
said Report, shall be assessed against the properties therein described,
which property fronts upon the improvement so constructed.
SECTION 4. That if such assessment is not paid within the time
permitted by law it shall constitute a special assessment and lien against
the property therein described, in the amounts set froth in said Report,
which lien shall continue until the assessment and all interest thereon is
paid.
SECTION 5. That if the assessment is not paid within the time
permitted, the City Clerk shall deliver a Notice of Lien, signed by the
Highways Code of the State of California, to the County Assessor acid Tax
Superintendent of Streets, as provided in Section 5891. of the Streets. and
collector, who, in accordance with applicable law, shall collect said
assessment, together with all other taxes relating to such properties.
SECTION 6. That the interest rate of six percent 6%) per annum
is hereby fixed as the rate of interest to be paid to the City upon the
amount due for unpaid assessments.
SECTION 7. That the City Clerk shall certify to the adoption of
this Resolution.
