HomeMy WebLinkAbout1984 019 CC RESO1984 019 CC RESO(Ììév I t RESOLUTION NO. 84-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK ORDERING THE VACATION OF A PORTION OF MERGED AVENUE 84-V-1) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That in accordance with the provisions of Public Streets Highways and Service Easements Vacation Law" Section 8300 et. seq. Streets and Highway Code) the City Council of the City of Baldwin Park adopted a Resolution declaring its intention to vacate a certain portion of a public street, to wit: a portion of Merced Avenue in the City of Baldwin Park, County of Los Angeles, State of California, as is more particularly described herein; and b) That said Resolution was duly published and the Notice of Street Vacation duly posted, all in the form, place, time and manner required by law and alt legal requirements have been met; and c) That this City Council, conducted the hearing required by said Resolution of Intention and heard alt evidence offered in relation to the proposed vacation, and considered the effect thereof on the City's General Plan; and d) That the portion of the public street proposed for vacation hereunder is described as in Exhibit B, and e) That based upon the evidence, it is founded hereby that said STREET AREA is not now needed for future or present public purposes; nor, is the same useful as a non-motorized transportation facility; and f) That the STREET AREA proposed for vacation is as on Exhibit A", attached hereto, and incorporated herein by this reference; and g) That from and after the date of recordation of this Resolution, the above-described STREET AREA shall no longer constitute a public street. SECTION 2. That, based upon the foregoing, the said STREET AREA be, and hereby is, ordered vacated, as an existing public street, provided that all of the easements and rights as described in Section 8340 a) of the Streets and Highways Code, to which reference is hereby made, are excepted and reserved. SECTION 3. That the City Clerk is hereby directed to certify to the passage of this Resolution and shall cause a certified copy thereof, to be recorded in the Office of the County Recorder, Los Angeles County, California. Beginning at the most Northeasterly corner of the Northerly 70 feet of the Southerly 220 feet of said Lot 25; thence Easterly 25 feet to a point on the centerline of Merced Avenue as described in said map of Valley View Acres, said point on a centerline being the point of curvature along a curve having a central angle of 45°36'23" and a radius of 400.00 feet; thence Southerly 133 feet, more or less, along the arc of said curve to the prolongation of the Southerly tine of the Northerly 74 feet of the Southerly 150 feet of said Lot 25; thence Westerly along said prolongation 45 feet, more or less, to a point on a curve having a central angle of 28°56'09" and a radius of 432.00 feet, last said point being the true point of beginning; thence Southerly along arc of said curve 44 feet, more or less, to a point on a tine having a bearing of North; thence along said tine with said bearing. North 40 feet, more or less, to the prolongation of the Southerly tine of the Northerly 74 feet of the Southerly 150 feet of said Lot 25; thence Westerly along said prolongation 17 feet, more or less, to the true point of beginning. PARCEL 2 The Easterly 15 feet of the Southerly 47.63 feet of Lot 26 of Valley View Acres, in the City of Baldwin Park, County of Los Angeles, State of California, as per map recorded in Book 12 Pages 86 and 87 of Maps in the Office of the Recorder of said County and the Westerly 25 feet of Merced Avenue as shown on said map of Valley View Acres bounded by the Easterly prolongation of the Northerly and Southerly tines of the Easterly 15 feet of the Southerly 47.63 feet of said Lot 26. Excluding therefrom that portion of Merced Avenue described as follows: Beginning at the Southeast corner of Lot 25 of said Valley View Acres; thence Easterly along the prolongation of the Southerly tine of said Lot 25, 43 feet, more or less, to a point on a curve having a central angle of 104°32'35" and a radius of 35.00 feet, said point being the true point of beginning, thence Southeasterly along the arc of said curve 40 feet, more or less, to a point on a line with a bearing of N74°37'00" E, said point being a point of curvature of last said curve; thence Easterly along said tine with said bearing 40 feet, more or less, to a line that is parallel with and distant 15 feet Westerly, measured at right angles, from said Easterly tine of Lot 26; thence Northerly along said parallel tine to the Northerly tine of said Lot 26; thence Easterly along the prolongation of the Northerly line of Lot 26, 58 feet, more or less, to the true point of beginning.
