A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF BALDWIN PARK DENYING A REQUEST
TO AMEND THE BALDWIN PARK MUNICIPAL
CODE RELATING TO ALLOWING CHURCHES WITH
A CONDITIONAL USE PERMIT IN THE C-2,
GENERAL COMMERCIAL ZONE, AZC-90.
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS:
SECTION 1.
SECTION 2.
SECTION 3.
That the City Council of the City of Baldwin Park does hereby find,
determine, and declare as follows:
a. That pursuant to the applicable provisions of the Planning
and Zoning Law Section 65850 et. seo. of the Government
Code of the State of California), studies were commenced
for the purpose amending the Zoning Code; and
b. That the Planning Commission has conducted a noticed public
hearing on the proposed amendment to the said Zoning Code;
and
c. That the Planning Commission recommended denial of the said
proposed amendment; and
d. That the proposed change does not provide adequate protection
of the health, safety, and welfare of the residents of Baldwin
Park; and
e. That the proposed change may be detrimental to properties within
the City; and
f. The proposed change is not consistent with the spirit and intent
of the General Plan.
g. That the City Council has conducted a noticed public hearing on
said recommendations, and has determined that the public interest
required the denial of AZC-90, to allow churches with a
conditional use permit in the C-2, General Commercial zone; and
That the amendment to the Zoning Code is hereby denied.
That the City Clerk shall certify to the adoption of this Resolution
and shall cause the same to be processed in the manner required by
law.
