LOCATION: 12858 RAMONA BOULEVARD; CASE NO: DR-3) THE CITY COUNCIL OF THE CITY OF BAIDWIN PARK DOES RESOLVE AS FOLLCMS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 12858 Ramona Boulevard, heretofore filed an application for an approval of a Development Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a 67-unit condominium project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Conrnission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said natter and recorrmsnded that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2, That the above-described Development Plan be, and the same hereby is, granted, subject to the following conditions: a) That the Property shall be developed and maintained substantially in accordance with Exhibit A", dated May 9, 1984, on file with the Secretary of the Planning Commission, except as otherwise modified by the express provisions of this Resolution; and b) That the Property shall be maintained in compliance with all applicable Federal, State, County and local laws; and c) That Exhibit A" shall be modified as follows: i) to show the type of individual unit, and to provide for lighted mailbox locations; and ii) the location of trash enclosures shall be shown at locations as are approved by the City Planner? and iii) to show mission tile or wood shingle roofing; and iv) to show additional windows on the end facades of each building; and BIB] 37673-U01 1984-U02 048-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10091-U03 DO10259-U03 C6-U03 RESO-U03 2/20/2003-U04 ROBIN-U04 1984 048 CC RESO(ÌìéþRESOLUTION NO. 84-48 PAGE TTO v) to shew a consistent garage door design for each building; and vi) to provide for noise reduction measures as approved by the City Planner for those units within two hundred 200) feet of Ranona Boulevard. d) That the applicant shall provide to the Planning Division for review and approval/ within thirty 30) days of the effective date of this Resolution, revised plans with the modifications required hereby, and a revised phasing plan; and e) That a subdivision map, necessary public improvement plans, and Covenants, Conditions and Restrictions shall be submitted for review and approval, together with a traffic analysis of the Ramona Boulevard and Francisquito Avenue inter- section; and f) That the applicant shall, at its sole expense, construct a left turn pocket lane and a separate left turn signal phase on Ranona Boulevard eastbound at Francisquito Avenue. Said improvements shall meet all standards and requirements of the City Engineer; and g) That the applicant shall file with the Planning Division, a written acceptance of these conditions of approval, in a form acceptable to the City Attorney. SECTION 3. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above findings of fact, and in reaching the conclusion that the Development plan should be conditionally approved. SECTION 4. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's Procedures. SECTION 5. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the manner prescribed by law. PASSED AND APPROVED this 20th da/y of June, 1984. MA^R ATTEST: r-____ LSSIDA L.
