A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALCWIN PARK DIRECTING
AND AUTHORIZING THE EXECUTION OF A
DENSITY BONUS AGREEMENT CASE NO.
Z-443)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS
FOLLOWS:
SECTION 1. That in conjunction with Zone Classification Case
No. Z-443, a request was submitted for a Density Bonus Agreemsnt. The
City Council has reviewed such request, in conjunction with the said Zone
Change application, and has determined that the public interest, convenience
and necessity require the execution, by the City, of such a Density Bonus
Agreement subject to the terms and conditions hereinafter set forth.
SECTION 2. That the City Manager is hereby instructed to execute
on behalf of the City of Baldwin Park, a Density Bonus Agreement with the
property owners of the property which is involved in Zone Change Case No.
Z-443. Said Agreerrent, being authorized pursuant to Section 65915 of the
Govemrrent Code, shall contain the following provisions:
a) That a total of twenty-three 23) dwelling units
shall be permitted; and
b) That not less than six 6) dwelling units shall
be set aside by appropriate covenants, conditions and
restrictions for sale to persons of low or moderate tnccane;
and
c) That said six 6) units available for low and
moderate income persons, shall be designated by the
developer, with the approval of the City Planner, and
the maximum sales prices shall be less than the maximum
allowable for persons of low or moderate income; and
d) That the property to which the Agreemsnt relates,
shall be constructed and maintained in accordance with the
provisions of Resolution No. 84-61 and applicable law;
and
e) That construction of the twenty-three 23) units
shall commence within one 1) year of the effective date
of Ordinance No. 874, or the Agreement shall be, automatically,
null and void.
SECTION 3. That the City Clerk shall certify to the adoption of
this Resolution and shall forward a certified copy hereof to the Secretary
of the Planning Conmission and to the applicant.
