LES PERANCE LOCATION: 14015 RANDNA PARKWAY CASE NO. ZV-498 THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOVLE AS FOLLOWS: SECTICN 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property at 14015 Ramona Parkway, more particularly described as Parcel 1 on Page 28 of Map Book 8544 of the los Angeles County Assessor, heretofore made applications for a zone variance, as hereinafter described/- and b) That the zone variance application, as modified, seeks permission to deviate from Section 17.34.030.5 of the Baldwin Park Municipal Code, in order to allow less than the minimum width and depth of garage spaces; and c) That said matter was considered by the Planning Ccimiission, which body denied the application; and d) That a timely appeal was taken, appealing the Planning Commission's decision to the City Council; and e) That the City Council conducted a duly noticed public hearing upon the said matter and determined that though some of the variance issues originally applied for were corrected in the resukmitted plans, the facts required pursuant to the Baldwin Park Zoning Code for the granting of the zone variance were not present, to wit: 1) There are no exceptional or extraordinary curcumstances or conditions applicable to the property involved or the intended use of such property, which do not generally apply to other property in the same zone, as standard sized garages could be provided if the floor plans are revised; and 2) That such variance is not necessary for the preservation by other property sijnilarly situated, but which is denied to the property in question, as all new multi-family projects are required to comply with this code requirement; and 3) That the granting of the variance may be materially detrimental to the public welfare or injurious to the adjacent property; and 4) That the granting of the variance may adversely affect the General Plan of the City of Baldwin Park, as granting this variance may set a precedent for allowing substandard sized garages; and f) That based upon the above findings of fact, the application should not be granted. That the City Clerk shall certify the adoption of this resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
