HomeMy WebLinkAbout1984 080 CC RESO1984 080 CC RESO(ÌìêlRESOLUTION NO. 84- 80 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN APPLICANT: SPEIGHT ENGINEERING CO; LOCATION: 4455i LA RICA AVENUE; CASE NO. Z-446) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 44551 La Rica Avenue, heretofore filed an application for an approval of a Development Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a five 5) unit single family residential project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recommended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical develop- ment of the land; and d) That the proposed development meets the letter of the law of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: A. That the subject property shall be developed and maintained in substantial compliance with Exhibit A" revised dated 9-12-84 and accompanying application dated August 22, 1984, except as may be expressly modified by the following: The plan shall be modified to indicate the following: BIB] 37673-U01 1984-U02 080-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10091-U03 DO10285-U03 C6-U03 RESO-U03 2/20/2003-U04 ROBIN-U04 1984 080 CC RESO(ÌìêlResolution No. 84-80 Page 2 of 3 1) A six 6) foot solid fence as shown on Exhibit A" shall be constructed on all property tines except along the south property tine where there is an existing block wall. Said fence shall be reduced to a height of three 3) feet within 15 feet of La Rica Avenue. Landscaping shall be provided adjacent to the entry fencing of the project. 2) Textured concrete paving fifteen 15) feet deep shall be provided at the entrance. 3) That two 2) or more exterior house colors shall be used. These colors shall be approved by the Planning Division. B. That a subdivision map, necessary public improve- ment plans, and Covenant,Conditions and Restrictions shall be submitted for review and approval by the City. C, That construction shall commence within one 1) year of the effective date of City Council adoption or the approval of the development plans shall be null and void. D. That the Planning Division shall have the authority to approve accessory structures. Said structures shall be placed in the private yard area, a maximum of 50 percent of the private yard area with a minimum dimension of ten 10) feet may be covered. A minimum yard area of five 5) feet shall be maintained. E. That the applicant shall sign a Maintenance of Landscaping Agreement and shall enter into an agreement with the local refuse company for on site pick up of trash. F. That a revised landscape plan shall be submitted for approval by the Planning Division. G. That the project shall meet the development standards of the Los Angeles County Fire Department; substantial revisions to the site plan shall be subject to Planning Commission and City Council review. H. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the ordinance that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Development Plan should be conditionally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the'applicant. The City Clerk shall file and post the Negative Declaration in the manner prescribed by law PASSED AND APPROVED THIS 17th day of Octol?er 1984.
