Z-448) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 13526 Tracy Street, heretofore filed pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a 26 unit zero lot line single family residen- tial project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Ccarmission of the City; and c) That the Planning Connission conducted a duly noticed public hearing on said natter and recornnended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the intent of the Planned Developnent Overlay Ordinance. SECTION 3. That the above described Developnent Plan be, and the same hereby is granted, subject to the following conditions; A. That the subject property shall be developed and maintained in substantial conpliance with Exhibit A" dated September 21, 1984, except as expressly modified by the following: The plan shall be modified to indicate the following: 1) All walls and fences shall be stucco coated with a pop out trim and/or cap stone; and an entry wall five 5) to six 6) feet in height reduced dcwn to three 3) feet next to the private street shall be constructed for units 16D and 14D adjacent to the cannon open space; the wall adjacent to Waco Street shall set back five 5) feet frcm the property line; the wall along Garvey shall have a minimum of t^o 2) additional pop outs for landscaping; and BIB] 37673-U01 1984-U02 088-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10091-U03 DO10277-U03 C6-U03 RESO-U03 2/20/2003-U04 ROBIN-U04 1984 088 CC RESO(ÌìêFResolution No. 84-88 Page 2 2) That the entrance design shall be modified to retain the 24 inch pine tree adjacent to Tracy Street; the site plan shall indicate the size and species of all trees to be saved. All trees to be removed shall be subject to the Planning Division's approval. Specimen trees of 24 inch box size or larger shall be planted in the entrance area, the center planter, and the cannon open space adjacent to Waco Street; and 3) The C C & R's shall reflect that the homeowner's association shall maintain all common areas and the landscaping of the front yard of each unit outside of the walled yard, the maintenance of the walls located on the perimeter wall, and future unit expansion shall be limited to patio covers only not to exceed 25 percent of the private yard area maintaining a three foot yard area on the project's north and south property line and 15 foot yard area adjacent to Waco Street and a ten 10) foot yard area adjacent to Cracy Street; and five 5) feet between buildings and not to be closer than six 6) feet from the neighboring blank wall property line; and 4) Common open space amenities shall be installed per the site plan; and 5) The applicant shall enter into an agreement for individual on site pick-up with the refuse company; 6) That an emergency entrance shall be provided from Waco Street, the cornon area shall be paved with turf block/- said entrance shall be gated and used only for emergency access; the Fire Department shall be provided a key to the gate. The access from, Tracy Street shall be provided with electric vehicular gates and a pedestrian access gate shall be provided to both Tracy Street and Waco Street; and 7) An electric garage door opener shall be provided for each unit; the garage door shall be a roll up door for units with eighteen 18) foot driveways. B. That the applicant shall submit to the Planning Division revised site plans and architectural drawings and tentative map, color samples, street light design, and C C & R's for review and approval prior to submitting for plan check; C. That construction shall commence within one 1) year of the effective date of City Council approval or approval of the development plans is null and void; D. That design approval is subject to this project meeting all design requirements of the Los Angeles County Fire Department. E. That the applicant shall submit for approval a tentative map with C C & R's and shall install all required public improve- ments. Said map shall show a common lot which shall include the private street and all common open space areas. F. That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the ordinance that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Develop- ment Plan should be conditionally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State of CEQA Guidelines, and the City's procedures. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Ccnrmission and to the applicant.
