HomeMy WebLinkAbout1984 089 CC RESO1984 089 CC RESO(Ììê@RESOLUTION NO. 84-89 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN APPLICANT: RODINE COMPANY; LOCATION: 1643 BIG DALTON AVENUE: CASE NO.: Z-449). SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 1643 Big Dalton Avenue, heretofore filed an application for an approval of a Development Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a twenty-five 25) unit single family zero lot line residential project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recommended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, detrimental that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2.That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: A. That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated November 7, 1984 and accompanying application dated September 21, 1984, except as may be expressly modified by the following: The plan shall be modified to indicate the following: 1) A11 waits and fences shall be stucco coated with a pop out trim and/or cap stone; and 2) The C C & R's shall state that the homeowner's association shall maintain all common areas and the landscaping of the front yard of each unit outside of the walled yard; provide for the Maintenance of the walls located on a property line; and future unit expansion shall be limited to patio cover only, not to exceed twenty-five 25) percent of the private yard area, and not be closer than six 6) feet from the neighboring blank wall property line; and BIB] 37673-U01 1984-U02 089-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10091-U03 DO10276-U03 C6-U03 RESO-U03 2/20/2003-U04 ROBIN-U04 1984 089 CC RESO(Ììê@Resolution No. 84-89 Case No.: Z-449 Page 2 of 3 3) That textured paving be provided as shown on Exhibit A"; and 4) The applicant shall enter into an agreement for individual on site pick up with the refuse company; and 5) That amenities, similar to those shown on the site shall be provided in common open space; and 6) That each lot shall be provided with not less than one street tree; and 7) That the perimeter walls adjacent to Big Dalton Avenue shall be designed to accommodate security vehicular gates and stacking for one vehicle; and 8) That additional architectural details shall be added to the rear elevation for units 4D; and 9) That roll-up garage doors be provided and that each unit having eighteen 18) feet driveway be provided with electric garage door openers; and 10) That units 16D, 17D and 8D be moved to within ten 10) feet to the interior street; and 11) That three 3) guest parking spaces be provided in the common open area nearest the entrance to the project. 12) That no guest parking be designated adjacent to the common open space area. B. That the applicant shall submit to the Planning Division revised site plans and architectural drawings and tentative map, color samples, street light design and C C & R's for review and approval prior to submitting for plan check. C. That the construction shall commence within one 1) year of the effective date of City Council approval or approval of the development plans is null and void. D. That design approval is subject to this project meeting alt design requirements of the Los Angeles County Fire Department and that said requirements be reflected on the site plan before approval by the City Council. E. That the applciant shall submit for approval a tentative map with C C & R's and shall install all required public improvements. Said map shall include a common lot which shall include the private street and a11 common open space areas. F, That the applicant shall sign a notarized affidavit within fifteen 15) days after the adoption of the resolution that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council retted upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Development Plan should be conditionally approved. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the manner prescribed by law. PASSED AND APPROVED THIS 7th day of Nbv^nber 1984. MAYOR ATTEST: L^NDA L.
