HomeMy WebLinkAbout1984 090 CC RESO1984 090 CC RESO(Ììê<RESOLUTION NO. 84- 90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN APPLICANT: RODINE COMPANY; LOCATION: 13333 E. BENBCW STREET; CASE NO. Z-450) THE CITY COUNCIL OF THE CITY OF BAinWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 13333 E. Beribow Street, heretofore, filed an application for an approval of a Developr^snt Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a fifteen 15) unit zero lot line single family residential project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Ccmmission of the City; and c) That the Planning Cormission conducted a duly noticed public hearing on said matter and recorrnended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and ccaiditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings and Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed developrient is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the letter of the law and intent of the Planned Development Overlay Ordinance, SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: A) That the subject property shall be developed and main- tained in substantial ccmpliance with Exhibit A", dated October 10, 1984, and acccmpanying application, dated September 21, 1984, except as may be expressly modified by the following: The plan shall modified to indicate the following: 1) All walls and fences shall be stucco, coated with a pop out trim and/or cap stone; and 2) Public utproveinents shall be installed as required by the Engineering Division. 3) The perimeter walls along the east side of lot 1 unit 1B) adjacent to Harlan Avenue shall maintain a five 5) foot landscaped setback from the property line. 4) The C C & R's shall state that the hcmecwner's association shall maintain all ccmmon areas and the land- BIB] 37673-U01 1984-U02 090-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO10091-U03 DO10275-U03 C6-U03 RESO-U03 2/20/2003-U04 ROBIN-U04 1984 090 CC RESO(Ììê<Resolution No. 84-90 Page 2 scaping of the front of each unit outside the walled yard, provisions for the maintenance of the walls located on a property line, and future unit expansion shil be limited to patio covers only, not to exceed twenty five 25) per- cent of the private yard area and not to be located closer than six 6) feet from the neighboring blank wall property line and maintain a three 3) foot setback fron perimeter. 5) That textured paving be provided at the entrance and at other location as shown on Exhibit A"; and 6) The applicant shall enter into an agreement for individual on site pick up with the refuse company; and 7) That twenty-four 24) inch box size or larger trees shall be planted in the entrance areas, and the cannon open space areas; and 8) That an electric garage door opener shall be pro- vided for each unit and that each unit be provided with roll up garage doors for those units with 18 foot long driveways. B) That the applicant shall submit to the Planning Division revised landscape plans and tentative map, color samples, street light design and C C & R's for review and approval prior to submitting for plan check. C) That construction shall corroence within one 1) year of the effective date of City Council approval or approval of the developtnsnt plans is null and void. D) That design approval is subject to this project meeting all design requirements of the Los Angeles County Fire Department. E) That the applicant shall submit for approval a tentative map with C C & R's and shall install all required public improvements. Said map shall include a cannon lot which shall include the private street and all common open space areas. F) That the applicant shall sign a notarized affidavit with- in fifteen 15) days after the adoption of the ordinance that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Developnrent Plan should be conditionally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provision of CEQA, the State CEQA. Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the manner prescrited by law. PASSED AND APPROVED THIS 7th day of Nqvmd?er 1984. r MAYOR ATTEST: C LliSIDAL.
