HomeMy WebLinkAbout1984 092 CC RESO1984 092 CC RESO(Ììê6RESOLUTION NO. 84-92 RESOLUTION OF THE CITY COUNCIL OY THE CITY OF BALDWIN PARK DETERMINING THAT THE CONSTRUCTION OF CERTAIN OFFSITE PUBLIC IMPROVEMENTS IN CONNECTION WITH THE DEVELOPMENT OF A HOTEL/SHOPPING CENTER PROJECT PURSUANT TO A DISPOSITION AND DEVELOPMENT AGREEMENT BY AND BETWEEN THE BALDWIN PARK REDEVELOPMENT AGENCY AND STANLEY W. GRIBBLE AND ASSOCIATES IS OF BENEFIT TO THE PUENTE-MERCED REDEVELOPMENT PROJECT AND THE IMMEDIATE NEIGHBORHOOD IN WHICH THE PROJECT IS LOCATED, DETERMINING THAT THERE ARE NO OTHER REASONABLE MEANS OF FINANCING SAID PUBLIC IMPROVEMENTS WHEREAS, the Baldwin Park Redevelopment Agency Agency") is authorized to carry out the redevelopment of the Puente-Merced Redevelopment Project Area Project Area"); and WHEREAS, the Redevelopment Plan for the Project Area authorizes and directs the Agency to pay all or part of the value of the construction and installation of certain public improvements; and WHEREAS, the Agency desires to enter into a Disposition and Development Agreement DDA") with Stanley W, Gribble and Associates Developer"), substantially in the form presented to this City Council at the meeting at which this resolution was adopted, which calls for the Agency to construct certain public street improvements Agency Improvements") in conjunction with the construction by Developer of a hotel consisting of at least 200 rooms with related restaurant and meeting room facilities, and an approximately 180,000 square feet shopping center with appropriate parking and landscaping Project"); and WHEREAS, California Health and Safety Code Section 33445 provides that a redevelopment agency may, with consent of the legislative body, pay all or part of value of public buildings, facilities, structures or other improvements upon a finding that such public improvements are of benefit to the Project Area or the immediate neighborhood in which the project is located and that there are no other reasonable means of financing said public improvements available to the community; and WHEREAS, California Health and Safety Code Section 33601 authorizes a redevelopment agency to accept financial assistance from the federal government for any redevelopment project within its area of operation and to comply with any conditions of said loan or grant; and WHEREAS, the Agency and the City Council has conducted a duly noticed public hearing regarding the DDA in accordance with California Health and Safety Code Sections 33431 and 33433. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1> This City Council hereby determines that the acquisition, construction and installation of the Agency Improvements will be of benefit to the Project Area and the surrounding neighborhood in which the project is located. This City Council further determines that no other reasonable means of financing the acquisition, construction and installation of the Agency Improvements is available, SECTION 3. This City Council hereby approves the form of the DDA and approves the sale of the real property more particularly described therein to the Developer at its estimated value determined at the highest use permitted under the Redevelopment Plan. This City Council hereby finds that such consideration is necessary to effectuate the purposes of the Redevelopment Plan based on the facts set forth in the report presented to this City Council at the meeting at which this resolution was adopted.
