HomeMy WebLinkAbout1984 095 CC RESO1984 095 CC RESO(ÌìçRESOLUTION NO. 84-95 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN APPLICANT: ANTHONY BARTOLI: LOCATION: 14600 OLIVE STREET: CASE NO.: Z-447). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare, as follows: a) That the owners of certain real property located at 14600 Olive Street, heretofore filed pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a 40 unit zero lot line single family residential project; and b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted duly noticed public hearings on said matter and recommended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact: a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: A. That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated November 14, 1984, except as expressly modified by the following: The plan shall be modified to indicate the following: 1. Perimeter walls shall be six feet in height and constructed of block material except that the wall along Olive shall be stucco and incorporate the use of wrought iron. 2. Wrought iron security gates shall be provided at each vehicle entrance to the site. 3. The two avocado trees located twenty 20) feet off Olive Street R.O.W. on either side of the easterly interior street entrance and the avocado trees located in the recreation area shall be retained and two speciman avocado trees shall be located on either side of the westerly interior street entrance twenty 20) feet from Olive Street to match the two 2) trees at the easterly entrance. Each lot shall be provided with no less than one 1) street tree. 5. Stucco walls not to exceed five 5) feet in height shall be provided across the front yard ef each unit located behind the gas and electric meter boxes, the precise location of which shall be approved by the Director. 6. The Covenants, Conditions and Restrictions CC&R's) shall reflect that the homeowners association shall maintain all common area and the landscaping in front of the wall mentioned in condition F. 7. The landscaped area outside north) of and including the wall adjacent and parallel to Olive Street and the interior street shall be part of lot 43 and designated as common area. 8. Units located on parcels one 1), forty-two 42), twenty- eight 28), and twenty-seven 27) of the Tentative Tract Map shall be provided with stucco and wood pop-outs similiar to the vents shown on elevations 2A of Exhibit A"; Roofing for all units shall be tile or a heavy composition random shake, as approved by the Director of Planning. 9. The CC&R's shall provide for a maintenance easement for repair and maintenance of each wall located on a property line and restrict future unit expansion to a patio cover not to exceed twenty-five 25%) percent of the rear yard area. B. That fifteen 15) feet of R.O.W. be dedicated to the City of Baldwin Park along the entirety of Olive Street on which the sub- ject site fronts. C. That a subdivision map, necessary public improvement plans including street trees, and Covenants, Conditions and Restrictions shall be submitted for review and approval by the City. D. That construction shall commence within 1) year of the effective date of City Council approval or the approval of the development plans shall be null and void. E. That the applicant shall sign a Maintenance of Landscape Agreement and shall enter into an agreement with the local refuse company for on-site pick up of trash, F. That all access, circulation, fire flows and fire protection must be approved by the Los Angeles County Fire Department. G. That the applicant sign a notarized affidavit within fifteen 15) days after the adoption of the ordinance that he has read and accepts all conditions of approval. SECTION 4, That the City Council relied upon the Administrative Record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Development Plan should be conditionally approved, SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the matter prescribed by law, PASSED AND APPROVED THIS 5th day of December 1984. MAYOR ATTEST: f/t^ LINDA L.
