A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF BAIWIN PARK DENYING A REQUEST FOR A ZONE
VARIANCE APPLICANT: FRITZ EHLERS: CASE NO.
ZV-518; LOCATION: 4150 PUEISTTE AVENUE)
THE CITY COUNCIL OF THE CITY OF BAU3WIN PARK DOES RESOLVE AS
FOLLCMS:
SECTION 1. That the City Council of the City of Baldwin Park
does hereby find, determine and declare as follows:
a) That application for a zone variance was submitted
by the owners of real property located at 4150 Puente Avenue/
described, rrore particularly as Parcel 8 on Page 22 of Map Book 8437
of the Los Angeles County Assessor's Records hereinafter Property")
attached hereto and incorporated herein by this reference; and
b) That the zone variance application seeks
permission to allow parking in a required side yard adjacent to the
street pursuant to Section 17.34.050.B of the City Code; and
c) That a duly noticed public hearing was held upon
said matter by the Planning Commission, and based upon the evidence
presented, it determined that the zone variance should be
conditionally approved; and
d) That the owners of the property filed a tirrisly
appeal of certain conditions of approval for the zone variance;
and
e) That the City Council conducted a duly noticed
public hearing on an appeal of the Planning Conmission's decision
relating to the zone variance and based upon the evidence presented
at said hearing, and each member of the City Council being familiar
with the site, the City Council determined that the public interest,
convenience, necessity and general welfare did not require the zone
variance, herein described.
SECTION 2. That the above described zone variance application be,
and the same hereby is, denied.
SECTION 3. That the City Clerk shall certify to the adoption of this
Resolution and shall forward a certified copy hereof to the applicant and
to the Secretary of the Planning Comiission.
