HomeMy WebLinkAbout1985 042 CC RESO1985 042 CC RESO(ÌìçýRESOLUTION NO. 85-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY CITY OF BALDWIN PARK APPROVING A DEVELOPMENT PLAN APPLICANT: ROSS SANGER; LOCATION 13716 MONTEREY AVENUE; CASE NO Z-452. THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follows: a) That the owners of certain real property located at 13716 Monterey Avenue, heretofore, filed an application for an approval of a Development Plan, pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, to allow the construction of a nine 9) unit zero lot line single family residential project/- and, b) That the real property hereafter Property") to which this application relates is more particularly described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the Planning Commission conducted a duly noticed public hearing on said matter and recommended that the same be approved, subject to certain conditions; and d) That the City Council conducted a duly noticed public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the following Findings of Fact. a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the letter of the law and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated April 24, 1985 with the following modifications: 1. That colored textured paving shall be provided in the driveways adjacent to the curb for lots 3, 4, 5, 6, and 7. The C C & R"s shall state that the homeowners' association shall maintain all common areas and the landscaping of the front of each unit outside of the walled yard, and future unit expansion shall be of patio covers only, not to exceed twenty-five 25) percent of the private yard area, main- taining a 3) three foot setback from perimeter or private open space walls, except that the five 5) foot yard areas between the units shall remain unobstructed; and 3. That twenty-four 24) inch box size or large trees shall be planted in the entrance areas, the center planter, and the common open space areas; and 4. That the landscaped areas outside of the perimeter walls adjacent to Monterey Avenue shall be part of the common lot/- and b) That the applicant shall submit to the Planning Division revised site plans and architectural drawings and tentative map, color samples, street light design and C C & R's for review and approval prior to submitting for plan check. c) That construction shall commence within one 1) year of the effective date of City Council approval or approval of the development plans is null and void. d) That design approval is subject to this project meeting all design requirements of the Los Angeles County Fire Department. e) That the applicant shall submit for approval a tentative map with C C & R's and shall install all required public improve- ments. Said map shall include a common lot which shall include the private street and all common open space areas. f) The applicant shall enter into an agreement with the local re- fuse company for on site pick up of refuse. g) That the applicant shall sign a notarized affidavit within 15) days after the adoption of the resolution that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council relied upon the administrative record, and the evidence presented at the public hearing in making the above Findings of Fact, and in reaching the conclusion that the Deve- lopment Plan should be conditionally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provision of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
