A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF BALDWIN PARK ESTABLISHING
THE MAXIMUM HOUSEHOLD INCOME ELIGIBLE
FOR EXEMPTION FROM THE CITY UTILITY
USERS TAX
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. That the City Utility Users Tax
imposed by Section 3.32.010 et seq. of the Baldwin Park
Municipal Code may create some financial hardship on
residents of the City whose incomes are very low.
SECTION 2. That the City Council is desirous of
implementing an exemption program to relieve some of that
burden.
SECTION 3. That therefore the tax imposed by said
Section 3.32.010 et seq. shall not apply during any utility
tax year to any person who uses telephone, gas, electric,
water, cable television and/or TWX teletypewriter services
in or upon any premises occupied by such individual provided
the combined gross annual income of all members of the
household in which such individual resides is less than the
very low" income limit established by the U.S. Department
of Housing and Urban Development, which limit represents
less than 50% of the median income of households in the Los
Angeles Area.
SECTION 4. That the Tax Administrator is hereby
authorized to exempt from the utility tax any Baldwin Park
resident whose combined annual gross household income is
below the income limits identified hereinabove and who has
satisfactorily filed all required application forms and
related documents with the City in accordance with the
provisions of Section 3.32.070 of the Municipal Code.
SECTION 5, That at such time as the very low"
income limits identified hereinabove are revised by the U.S.
Department of Housing and Urban Development and the City is
so notified, the Tax Administrator shall apply the new
income limits to all applications for exemption filed
subsequent to the date of such notification.
SECTION 6. That the City Clerk shall certify to
the adoption of this Resolution.
