HomeMy WebLinkAbout1985 106 CC RESO1985 106 CC RESO;¢fìùZRESOLUTION NO. 85-106 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, CONCURRING WITH THE MARCH 1984 UPDATE OF THE LOS ANGELES COUNTY SOLID WASTE MANAGEMENT PLAN, NONHAZARDOUS WASTE ELEMENT AND OPPOSING THAT PORTION OF SECTION 3 OF REVISION A ENTITLED NEW LANDFILL CLASS III) LOWER AZUSA ROAD LANDFILL" AND THAT PORTION OF SECTION 4 ENTITLED WASTE-TO-ENERGY FACILITIES SPADRA PROJECT" AND AZUSA PROJECT" WHEREAS/ the State Solid Waste Management and Resource Recovery Act of 1976 requires preparation of a County Solid Waste Management Plan hereafter referred to as the Plan) and updating of the Plan every three years; and WHEREAS, the California Waste Management Board approved the Plan on December 26, 1977; and WHEREAS, since adoption and implementation of the Plan, a number of changes have occurred which would warrant a compre- hensive update of the Plan elements; and WHEREAS, update of the Plan, Nonhazardous Waste Element, dated March, 1984, has been completed by the County Solid Waste Management Committee; and WHEREAS, the majority of the cities within the County which contain a majority of the population of the incorporated areas of the County approved the updated Plan by resolution; and WHEREAS, on December 18, 1984, the updated Plan was submitted to the Board of Supervisors for approval consideration but the Board found the Plan to be deficient in its identification of established land disposal sites; and WHEREAS, during approximately one year from preparation of the updated Plan, changes have occurred and requests for revisions have been received which resulted in the preparation of Revision A to the updated Plan; and WHEREAS, the updated Plan, Nonhazardous Waste Element, and Revision A are subject to approval by the majority of the cities within the incorporated area of the County; and WHEREAS, the updated Plan, Nonhazardous Waste Element, and Revision A was submitted to the City of Baldwin Park for approval. NOW, THEREFORE/THE CITY COUNCIL OF THE CITY OF BALDWIN PARK/ DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOW: SECTION 1. That although the proposed Class III landfill Lower Azusa Road Landfill) would be located within the City of Arcadia, and the proposed Waste-to-Energy Facilities would be within the cities of Walnut and Azusa the proximity of these proposed facilities to the City of Baldwin Park may impact the residents of the City of Baldwin Park. That there has not been a sufficient environmental review of the proposed sites to include them in the Plan at this time. SECTION 3. That the proposed landfill is to utilize an existing gravel pit that is below the water table. The effect on water quality has not been adequately established to sufficiently protect the health and safety of the residents of the San Gabriel Valley. SECTION 4. That the City Council of the City of Baldwin Park hereby approves the County Solid Waste Management Plan/ Nonhazardous Waste Element, Revision A, but opposes that portion of Section 3 entitled New Landfills Class III) Lower Azusa Road Landfill" and that portion of Section 4 entitled Waste-to-Energy Facilities Spadra Project" and Azusa Project".
