HomeMy WebLinkAbout1986 021 CC RESO1986 021 CC RESO;¢fìúARESOLUTION NO. 86-21 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, CERTIFYING THE FINAL ENVIRONMENTAL IMPACT REPORT ON THE ADOPTION OF GENERAL PLAN AMENDMENTS AGP-72/ ZONE CHANGES 2-457, Z-458, Z-459, Z-460 AND ZONING CODE AMENDMENTS AZC-102, AZC-103, AZC-104, AZC-105 AND THE REDEVELOPMENT PLAN FOR THE PROPOSED SIERRA VISTA REDEVELOPMENT PROJECT WHEREAS, the Community Redevelopment Agency of the City of Baldwin Park the Agency") has initiated the formation of the Sierra Vista Redevelopment Project the Redevelopment Project") in the City of Baldwin Park and has recommended certain General Plan amendments, zone changes and Zoning Ordinance amendments related to the redevelopment project collectively, the Project"); and WHEREAS, the Agency has prepared a Redevelopment Plan for the Redevelopment Project; and WHEREAS, the Agency and the City are joint lead agencies for the Project and have caused to be prepared a Final Environmental Impact Report FEIR") for the Project pursuant to the California Environmental Quality Act of 1970 Public Resources Code 21000 et_ seq., CEQA") for the Project; and WHEREAS, the Draft Environmental Impact Report for the Project DEIR") was made available for public review in accordance with CEQA and duly noticed public hearings on the DEIR were held before the Planning Commission of the City of Baldwin Park. The Planning Commission carefully reviewed and fully considered the DEIR and recommended to the City Council that the DEIR be approved; and WHEREAS, the Baldwin Park City Council has fully reviewed and carefully considered the Final Environmental Impact Report FEIR") for the Project, including but not limited to all comments on the Draft EIR and the responses thereto; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK AS FOLLOWS: Section 1. The City Council hereby certifies that the FEIR for the Project was presented to the City Council and the Council reviewed and considered the information contained therein. Section 2. The FEIR has identified the following significant effects but in response to each significant effect so identified, the Project has been altered to avoid or substantially lessen the environmental effects as set forth in the FEIR and as summarized below: 1- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúAA. Earth. The Project has been changed or altered to avoid or substantially lessen the potential effects on geology and soils by requiring the following: 1) that all grading comply with City regulations; 2) that construction activities comply with the City's dust control regulations; 3) that geologic/soils reports, including construction recommendations should be required for major developments; 4) that new construction should be designed to withstand anticipated ground shaking within an acceptable level of risk, in accordance with City standards; 5) that standard wood frame construction in compliance with the latest state of art seismic building codes should be used whenever possible; and 6) flexible joints be provided where utility lines enter structures and at corners within structures. B. Air Quality. The Project has been changed or altered to avoid or substantially lessen the potential effects on air quality by requiring the following: 1) implementation of direct emission reduction, land use planning and transportation control measures as more fully described in Section 5.2 of the FEIR; and 2) compliance with the City's dust control regulations to reduce dust during construction activities. Except that new development in the project area will increase the emission of air pollution in the area and a significant unavoidable cumulative adverse impact is anticipated. C. Water. The Project has been changed or altered to avoid or substantially lessen the potential effects on water by requiring the following: 1) the proposed construction of curb and gutter channels; 2) the proposed construction of a storm drain and drainage inlet; 3) the implementation of measures on individual development projects to reduce 2- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúArunoff as more fully described in Section 5.3 of the FEIR; and 4) the amount of grading and disturbance associated with the new development should be minimized and development design should include measures to ensure adequate drainage including construction of open or closed conveyance structures, greenbelts. A beneficial impact on the drainage in the project area will result from imposition of the proposed curb and gutters. D. Vegetation and Wildlife. The Project has been changed or altered to avoid or substantially lessen the potential effects on vegetation and wildlife by requiring the following: 1) recommended use of native vegetation in landscaping where compatible with fire protection measures to maintain biotic diversity? and 2) mature trees removed through redevelopment activities should be replaced on a one-for-one basis. E- Noise. The Project has been changed or altered to avoid or substantially lessen the potential effects on noise by requiring the following: 1) noise attenuation barriers to be built in conjunction with new development in residential areas impacted by noise levels exceeding the state or local noise contour limits; 2) site preparation and construction activities should be limited per the City's ordinance to designated construction hours; 3) any new residential units constructed within the 65 dBA noise contour will require special acoustical treatment and 4) the required 20 percent set-aside of future tax increments from the project area for improvement of low and moderate income housing can be used, in part, to provide housing rehabilitation including insulation for noise attenuation where existing low and moderate housing is adversely affected by existing and future noise levels in the project area. F. Light and Glare. The Project has been changed or altered to avoid or substantially lessen the potential effects on light and glare by requiring the following: 3- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúA1) lighting in parking areas should not exceed one footcandle and should be directed away from adjacent areas; and 2) during site plan review City should ensure that potential light/glare impacts do not affect adjacent land uses and the use of reflective glass or other reflective material should be minimized without affecting energy conservation. G, Land Use. The Project has been changed or altered to avoid or substantially lessen the effects on land use by requiring the following: 1) review of individual site plans and environmental review of future development projects to ensure land use compatibilityr and where significant environmental effects are identified require the preparation of subsequent or tiered environmental documents; 2) displacement will be mitigated through required relocation assistance and agency-owner participation responsibili- ties per the applicable provisions of the California Health and Safety Code; 3) City should employ a Code enforcement program to eliminate non-conforming uses in the project area; 4) where heavy commercial uses adjoin residential neighborhoods, screening and buffering techniques should be employed; and 5) General Plan land use designations should be periodically reevaluated to ensure a viable pattern of land use development in the project area. H. Population and Housing. The Project has been changed or altered to avoid or substantially lessen the effects on population and housing by requiring the following: 1) twenty percent 20%) of all taxes allocated to the Agency will be used for the purpose of increasing and improving the City's supply of low and/or moderate income housing; and 2) the Project is intended to encourage the provision of low and moderate housing both within and without the project area. I. Traffic-Circulation. The Project has been changed or altered to avoid or substantially 4- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúAlessen the potential effects on traffic and circulation by requiring the following: 1) requiring site-specific traffic studies on major development proposals; and 2) the proposed circulation system improve- ments as set forth in section 5.10 of the FEIR are expected to mitigate Project- generated impacts on traffic. J. Public Services. The Pro:ect has been altered or changed to avoid or substantially reduce the potential effects on public services by requiring the following: 1) proposed rehabilitation activities will help to reduce fire protection demand; 2) new development in the project area will comply with current fire codes and City security requirements; 3) adequate security design measures should be required for all new development based on police department recommendations; 4) consultation with the affected school districts by the Agency to discuss construction of new school facilities and the potential of leasing arrangements; and 5) absent alternative funding the Agency may negotiate private developers' agree- ment(s) for the dedication of a new school site for either affected school district serving the project area or for assistance on the expansion of existing school facilities. K. Energy Conservation. The Project has been altered or changed to avoid or substantially reduce the potential effects on energy conservation by requiring the following: 1) utility companies should utilize the same trenches when relocating or upgrading their facilities to minimize the use of diesel fuel; 2) if solar healing systems are incorporated into design of proposed buildings, site planning must ensure that solar radiation is unobstructed; 3) appropriate landscaping well-placed used to moderate temperature; 4) provision of pedestrian amenities to encourage greater pedestrian activity and less driving; 5- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúA5) all buildings in the project area shall comply with Energy Conservation standards as set forth in Title 24 of the California Administrative Code; 6) buildings should be orientated toward the south when feasible to maximize solar exposure and natural heat; 7) energy efficient appliances and low-flow or water-saving plumbing fixtures should be installed in all new residences as more specifically set forth in Section 5.12 of the FEIR; 8) active solar energy systems should be considered for use in heating domestic water and swimming pools; 9) energy efficient lighting should be used; 10) native or exotic plants that are adapted to City's climate should be used in landscaping; 11) Agency structural rehabilitation programs should include energy-saving improve- ments; and 12) Southern California Edison and Southern California Gas Company's energy management programs providing assistance to developers should be used. Except that the Project implementation will result in increased energy consumption and a cumulative adverse impact on energy consumption is anticipated. L- Utilities. The Project has been altered or changed to avoid or substantially lessen the potential effect on utilities by requiring the following: 1) recommend source separation of recyclable materials to reduce solid waste generation; and 2) recommend implementation of water and sewage conservation measures as more fully described in section 5.13 of the FEIR. Section 3. The City Council finds that the mitigating changes which will be incorporated into the Project and discussed above will avoid or substantially lessen most of the significant effects identified in the Final EIR. However, specific economic, social, and other considerations, set out specifically hereinafter, make it unfeasible to avoid or substantially lessen through the use of mitigation measures or project alternatives the significant effects of air quality and energy consumption identified in the Final EIR. Therefore, the City Council 6- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúAfinds that these significant effects are unavoidable for the reasons set forth below. The City Council finds that the benefits of the Project will outweigh the adverse environmental effects which have been found to be unavoidable. Based on this finding, the rationale for which is set out below for each unavoidable environmental effect, the City Council finds that the unavoidable adverse environmental effects are acceptable. The following sets forth the analytical basis for the statutory findings: A. Air Quality. The Project will contribute to the degradation of air quality. The City Council finds that this effect is unavoid- able. The City Council also finds that the following benefits will result from the proposed Project: 1) encourage private investment in the area and mitigate existing physical, social and economic blight? 2) facilitate commercial and light industrial growth; 3) provide needed public facilities and improvements; 4) provide improved and increased low and moderate income housing; and 5) provide increased employment oppor- tunities within the project area. The City Council has balanced the Project benefits against the unavoidable environmental risks and finds that the unavoidable environ- mental risks are acceptable because the Project benefits outweigh the unavoidable environmental risks relating to air quality. B. Energy Consumption. The Project will result in increased energy consumption due to new development. The City Council finds that this effect is unavoidable. The City Council also finds that the following benefits will result from the proposed Project: 1) encourage private investment in the area and mitigate existing physical, social and economic blight; 2) facilitate commercial and light industrial growth; 3) provide needed public facilities and improvements; 4) provide improved and increased low and moderate income housing; and 1- DJF/RES3452 BIB] 37847-U01 1986-U02 021-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20711-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 021 CC RESO;¢fìúA5) provide increased employment oppor- tunities within the project area. The City Council has balanced the Project benefits against the unavoidable environmental risks and finds that the unavoidable environ- mental risks are acceptable because the Project benefits outweigh the unavoidable environmental risks relating to energy consumption. Section 4. In view of the foregoing, the City Council hereby certifies that the FEIR for the Project has been completed in accordance with the provisions of CEQA and applicable state and local guidelines. The City Clerk is hereby authorized and directed to file a Notice of Determination as required pursuant to CEQA.
