HomeMy WebLinkAbout1986 027 CC RESO1986 027 CC RESO;¢fìú/RESOLUTION NO. 86-27 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING A PETITION REQUESTING FORMATION OF AN ASSESSMENT DISTRICT LITTLEJOHN STREET AD 86-1) THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council does hereby find, determine and declare as follows: a) That in accordance with the provisions of Section 2804 of the California Streets and Highways Code/ the owners, as defined in Sections 2804 and 2804.2 of said Code, of more than sixty percent 60%) in area of all of the real property proposed to be subjected to assessment for the certain public improve- ments and acquisitions related thereto, hereafter described have signed and filed with the City Clerk of the City of Baldwin Park a written Petition re- questing formation of an assessment district by proceedings to be taken by the City Council pursuant to the Municipal Improvement Act of 1913, and for the issuance of bonds in said proceedings under the Improvement Bond Act of 1915, and by said Petition have waived all proceedings required by the provisions of Division 4 of said Streets and Highways Code being the Special Assessment Investigation, Limitation and Majority Protest Act of 1931; Streets and Highways Code Sections 2800-3022 inclusive; and b) That the Petition is in proper form; and c) That said City Council proposes, based upon said Petition, to adopt a Resolution of Intention expressing its intention to undertake proceedings as requested; and d) That the Petitioners have submitted to the City, confidential evidence relating to the value of the Property described in the said Petition? that the confidential evidence so submitted has been evaluated and based thereon it has been determined by this City Council that the total amount of the proposed assessments upon the said Property, if the assessment district is formed and the improvements constructed as proposed, will not exceed 75% of the estimated fair market value of the said Property after the construction of said improvements; that the staff and City Council have satisfied themselves that the said confidential evidence relating to value is satisfactory and the estimate as hereinabove described is accurate based thereon; and e) That the Petitioners have supplied to the City Clerk, an affidavit which reflects the existence of all mortgagees or beneficiaries under all existing mortgages or deeds of trust relating to the said Property and that all persons named as said mortgagees or beneficiaries have in fact signed the said Petition; and f) That the public interest requires acceptance of this petition and formation of said District. That the City Council hereby accepts said petition and orders staff to commence the steps to form the assessment district as requested. SECTION 3. That the City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 4th/day of June/ 1986.
