HomeMy WebLinkAbout1986 028 CC RESO1986 028 CC RESO;¢fìú(RESOLUTION NO. 86-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROVING THE ENGINEER'S REPORT" FOR CERTAIN LANDSCAPING AND LIGHTING MAINTENANCE IN A MAINTENANCE DISTRICT WITHIN THE CITY OF BALDWIN PARK WHEREAS, pursuant to the provisions of Division 15, Part 2, of the Streets and Highways Code of the State of California, being known as the Landscaping and Lighting Act of 1972" an Engineer's Report has been prepared consisting of Plans and Specifications, an Estimate of the Cost, a Diagram of the Maintenance District, and an Assessment relating to what is now known and designated as CITY OF BALDWIN PARK CITYWIDE LANDSCAPING AND LIGHTING MAINTENANCE DISTRICT hereinafter referred to as the District"); and WHEREAS, there now has been presented to this City Council the Report" as required by Division 15 of the Streets and Highways Code; and WHEREAS, this City Council has now carefully examined and reviewed the Report" as presented, and is satisfied with each and all of the items and documents as set forth therein and is satisfied that the assessments, on a preliminary basis, have been spread in accordance with the benefits received from the maintenance to be performed as set forth in said Report". HOW, THEREFORE IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF BALDWIN PARK, CALIFORNIA, as follows: SECTION 1. That the above recitals are all true and correct. SECTION 2. That the Report" as presented, consisting of the following: a. Plans and Specifications; b. Estimate of the Cost; c. Diagram of the Maintenance District; d. Assessment of the Estimated Cost; is hereby approved on a preliminary basis, and is ordered to be filed in the office of the City Engineer as a permanent record and to remain open for public inspection. SECTION 3. That the City Clerk shall certify to the passage and adoption of the Resolution and the Minutes of this meeting shall so reflect the presentation of the Engineer's Report". Landscaping and Lighting Act of 1972 being Part 2, Division 15. of the Streets and Highways Code. The report covers the period from July 1, 1986 through June 30. 1987, SECTION II PLANS The plans showing size and location of street lights are incorporated herein by reference. Plans showing the general location of land- scaping to be maintained are incorporated herein by reference. All of the above mentloned items are on file in the office of the City Enqfineer SECTION III SPECIFICATIONS FOR MAINTENANCE The Lighting system shall be maintained to provide adequate i1lumination, Maintenance shal1 melude but not be limited to removal, repair, replacement or relocation of light standards, poles„ bulbs, fixtures;, circuits and all appurtenances, Power for lights shall be furnished by the Southern California Edison Company or its successors or assigns and it shal1 be adequate for the intended purpose. Rates for power shall be those authorized by the Public Ut i lilies Commission., State of Call forma, Landscapincf maintenance shall consist of installing cutting., prumnq tr imm ing fertiliz mg and treat ing plans shrubs trees ground cover and soil to provide a pleasing and attractive landscape within the public right-of-way and publicly-owned grounds. Dead plants shrubs, trees and ground cover shall be replaced with new items as soon as practical, The irrigat ion system shall be operated and maintained to provide adquate watering of all plants,, shrubs, trees and ground cover Irrigation systems shall be installed as deemed appropriate by the Maintenance Superintendent. SECTION vl ASSESSMENT The landscaping and lightincr is for the benefit and en loument of all properties within the District and all parcels benefit from the maintenance of the improvements, The assessment of cost upon each parcel was apportloned in accordance with the estimated benefit received. The criteria used for the assessment spread 15 as to 1 lows 1. As in the past, the General Fund will subsidize the District with a loan. The de ficit can be attr ibuted to the rising costs of main- tenance and oper at ions and difficulties experienced in accurately pro jecling a portion of the revenue stream leadinq to an over estimate of revenues, The assessment number and the amount of assessment upon each lot or parcel are shown on the assessment roll. Upon confirmation by the Counci1 these data will be submitted to the County Auditor-Controller for the inclusion on the 1986-1987 tax roll.
