HomeMy WebLinkAbout1986 037 CC RESO1986 037 CC RESO;¢fìúRESOLUTION NO. 86-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK MAKING CERTAIN PROFESSIONAL APPOINTMENTS FOR ASSESSMENT DISTRICT. NO. 86-1 AND DIRECTING THAT CERTAIN ACTS BE TAKEN IN FURTHERANCE OF THE DISTRICT'S FORMATION WHEREAS, Ellis Sloan Burnett Properties has submitted a Petition to this City Council for construction of certain improvements pursuant to the Municipal Improvement Act of 1913, and for the issuance of bonds under the Improvement Bond Act of 1915 to represent special assessments to be levied against properties within a proposed assessment district to be designated as Assessment District No. 86-1; and WHEREAS, the public interest and convenience requires the construction of said improvements; and NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of Baldwin Park, California as follows: SECTION 1. That the firm of Psomas & Associates is hereby designated and appointed engineer of the work and employed to do and perform all engineering work necessary in and for the proceedings, including preparation of the description of improve- ments and acquisitions, the boundary map, and the estimate of costs and diagram and assessment. Compensation for such work shall be as set forth in the agreement by and between said firm and the City heretofore approved by the City Council. SECTION 2. That the firm of Rutan & Tucker, Attorneys at Law, is hereby designated and appointed special bond counsel with respect to the assessment proceedings and is employed to perform all legal work relating to said assessment proceedings. Fees and costs for such work shall be as set forth in said firm's letter agreement with the City, dated May 2, 1986. SECTION 3. That the firm of Gunn, Russell Copenhaver & Co., Inc. is hereby designated and appointed financing con- sultant with respect to the assessment proceedings and is employed to perform all financial work relating to said assessment proceedings. Compensation for such work shall be as set forth in said firm's letter agreement with the City, dated May 27, 1986. SECTION 4. That the staff of the City is hereby directed to undertake all acts which are necessary or advisable with respect to the furtherance of said proceedings, specifically including negotiation of appropriate agreements with Ellis Sloan Burnett Properties in connection therewith, the acquisition, by condemnation or otherwise, of right-of-way for said improve- ments, and such other matters which staff deem necessary or advisable.
