HomeMy WebLinkAbout1986 039 CC RESO1986 039 CC RESO;¢fìúRESOLUTION NO. 86-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK PRELIMINARILY ADOPTING, CONFIRMING AND APPROVING ENGINEER"S REPORT FOR PROPOSED ASSESSMENT DISTRICT NO. 86-1 AND APPOINTING TIME AND PLACE FOR HEARING PROTESTS TO PROPOSED IMPROVEMENTS WHEREAS, the City Council of the City of Baldwin Park, by Resolution NO. 86-38 heretofore adopted by the City Council on June 4, 1986, declared its intention to construct certain improvements in proposed Assessment District No. 86-1, therein described; and WHEREAS, the City Council in and by the resolution referred the proposed work to the Engineer, and directed the Engineer to make and file with the City Council a report con- taining the matters specified in Section 10204 of the Streets and Highways code; and WHEREAS, the Engineer has on this date filed with the Clerk of the City Council a report in writing containing the matters specified in Section 10204 of the Streets and Highways Code, including the following: a) Plans and specifications of the proposed improvement if the improvement is not already installed; b) A general description of the property necessary or convenient for the operation of the work and improvements and of the property to be acquired as a part of the improvement; c) An estimate of the cost of the proposed improvements and acquisitions and incidental expenses in connection therewith; d) A diagram showing the Assessment District and the boundaries and dimensions of the subdivisions of land within the district as they existed at the time of the passage of the resolution, each of which subdivisions has been given a separate number upon the diagram/and showing the relative location of the parcels of land to the work proposed to be done and the improvements to be made; e) A proposed assessment of the total amount of the cost and expenses of the proposed improvements distributed and allocated upon the several subdivisions of land in the district in proportion to the estimated benefits to be receiveed by such subdivisions, respect- ively, from the improvements; and WHEREAS, the report has been duly presented by the Clerk to the City Council for consideration and has been fully considered by the City Council; NOW THEREFORE IT IS HEREBY RESOLVED by the City Council of the City of Baldwin Park, California, as follows: BIB] 37847-U01 1986-U02 039-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20693-U03 C6-U03 RESO-U03 8/13/2003-U04 ROBIN-U04 1986 039 CC RESO;¢fìúResolution NO. 86-39 Page Two SECTION 1. That the report including the plans/ specifications, general description, estimate of the cost of acquisitions and improvements and incidental expenses in connection therewith/ diagram and proposed assessment, are hereby preliminarily adopted, confirmed and approved. SECTION 2. That Wednesday, the 16th day of July, 1986, at 7:00 p.m., or as soon thereafter as possible, in the chambers of the City Council in the City Hall/14403 East Pacific Avenue/ Baldwin Park, Califoria, is hereby fixed as the time and place for hearing protests to the proposed improvements. Any interested person may object to the proposed acquisitions and improvements or the extent of the assessment by filing a written protest with the City Cleric at or before said time set for said hearing, and the City Clerk shall endorse on each protest the date of its receipt and at said time appointed for said hearing shall present to the City Council all protests filed with the City Clerk. SECTION 3. The City Clerk is directed to cause notice of the hearing for protests to be published, posted, and mailed in accordance with Sections 10301 through 10309 of the California Streets and Highways Code.
