HomeMy WebLinkAbout1986 062 CC RESO1986 062 CC RESO;¢fìøÜRESOLUTION NO. 86-62 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DELCARING ITS INTENTION TO ORDER CREATION OF DELTA ASSESSMENT DISTRICT WHEREAS, the Baldwin Park Redevelopment Agency has requested the institution of proceedings for the acquisition of certain improvements by creation of Delta Assessment District No. 86-2 hereafter District"), as shown on that certain Map designated Proposed Boundaries of Delta Assessment District No. 86-2"; and WHEREAS, the consent of this legislative body has given for the creation of Delta Assessment District No. 86-2 and for the acquisition of improvements and levy of assessments on parcels in the District as shown on said Map; and NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. The public interest, convenience and necessity require/ and it is the intention of the City Council pursuant to the provisions of Division 12 of the Streets and Highways Code of the State of California, said division being the Municipal Improvement Act of 1913, to order the acquisition of improvements in the City of Baldwin Park, State of California, as shown on Exhibit A, attached hereto and incorporated herein by this reference. SECTION 2. The district to be benefited by said improvement and to be assessed to pay the cost and expense thereof and to be known as Delta Assessment District No. 86-2" shall be that part of the City of Baldwin Park having exterior boundaries as shown on the Map of the District, approved by by Resolution No. 86-61___of the City Council of Baldwin Park, adopted August 6, 1986, which map is on file in the office of the City Clerk. Reference hereby is made to the map for a full and complete description of the proposed District, and the map shall govern all details as to the extent of the proposed District. SECTION 3. The Engineer of Work shall furnish to the City Council a report in writing pursuant to Section 10204 of the Streets and Highways Code, presenting to following: 1) Plans and specifications of the improvements proposed for acquisition in Delta Assessment District No 86-2; and 2) An estimate of the cost of the proposed acquisition, including incidental costs and expenses in connection therewith; and 3) A diagram showing the proposed District, which diagram also shall show the boundaries and dimensions of the sub- divisions of land within the District, each of which subdivisions shall be given a separate number upon said diagram; and BIB] 37847-U01 1986-U02 062-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20615-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1986 062 CC RESO;¢fìøÜResolution No, 86-62 Page 2 4) A proposed assessment of the total amount of the cost and expenses of the proposed improvement upon the several subdivisions of land in said District in proportion to the estimated benefits to be received by such subdivisions/ respectively, from said improvements. Said assessment shall refer to such subdivisions upon said diagram by the respective numbers thereof. SECTION 4. The public interest, convenience and necessity require that certain land, rights-of-way, easements and improvements to be obtained in order to fulfill the purposes proposed for the District. For a general description of the location and extent of the easements or lands necessary to be acquired, reference is made to maps on file with the city Clerk. SECTION 5. Serial bonds to represent the unpaid assessments, and bearing interest at the rate of not to exceed the current legal maximum rate of 12% per annum, will be issued hereunder in the manner provided in the Improvement Bond Act of 1915, being Division 10 of the Streets and Highways Code of the State of California, the last installment of which bonds shall mature a maximum of and not to exceed fourteen 14) years from the second day of September next succeeding twelve 12) months from their date. The provisions of Part 11.1 of said Act, providing an alternative procedure for the advance payment of assessments and the calling of bonds, shall apply. The principal amount of the bonds maturing each year be other than an amount equal to an even annual proportion of the aggregate principal of the bonds, and the amount of principal maturing each year, plus the amount of interest payable in that year, will be generally an aggregate amount that is equal each year, except for the first year's adjustment. Pursuant to the provisions of Section 10603 of the Streets and Highways Code of the State of California, the City Treasurer of the City of Baldwin Park is hereby designated as the officer to collect and receive the assessments during the cash collection period. Said bonds further shall be serviced by the Treasurer, or designated Paying Agent. SECTION 6. If any excess shall be realized from the assessment, it shall be used, in such amounts as the City Council may determine, in accordance with the provisions of law for one or more of the following purposes; A. Transfer to the general fund; provided that the amount of any such transfer shall not exceed the lesser of One Thousand Dollars $1,000.00) or five 5%) of the total from the Improvement Fund; B. As a credit upon the assessment and any supple- mental assessment; or C. For the maintenance of the improvement. A special improvement fund identified and designated by the name of this District is hereby established, and into said fund monies may be transferred at any time to expedite the making of the improvements herein authorized, and any such advancement of funds is a loan and shall be repaid out of the proceeds of the sale of bonds as authorized by law. SECTION 8. The City Clerk of the City of Baldwin Park, whose telephone number is 818) 960-4011, hereby is designated by the City Council to answer inquiries regarding the hearing procedures for the Resolution of Intention and to answer inquires relative to any hearing or proceedings concerning this project where it is required by statute that such agency and telephone number be so designated and provided. SECTION 9. The City Clerk shall certify to the adoption of this resolution, and thenceforth and thereafter the same shall be in full force and effect. The work shall generally consist of bridge construction including bridge desk, piers, abutments, girders, railing, walkway, etc.; street construction including grading, curbs, gutters, s idewalks, base, A.C. pavement, catch has in, pipes, outlet, etc, and utilities consisting of gas, water/ sewer, telephone and electrical. For exact extent and limit of said work, plans labeled Los Angeles County Department of Public Works project No. 3047N are on file in the City Engineer's office which show the extent and type of work.
