HomeMy WebLinkAbout1986 077 CC RESO1986 077 CC RESO;¢fìø¤RESOLUTION NO. 86-77 A RESOLUTION OF THE CITY OF BALDWIN PARK, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON NOVEMBER 4, 1986, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY AN ORDINANCE RELATING TO THE ADOPTION OF A REDEVELOPMENT PLAN FOR THE SIERRA VISTA REDEVELOPMENT PROJECT FOR THE CITY OF BALDWIN PARK AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE. WHEREAS, the City Council of the City of Baldwin Park did on the 2nd day of July, 1986 duly adopt Ordinance No. 947 providing for the adoption of the Redevelopment Plan for the Sierra Vista Redevelopment Project for the City of Baldwin Park; and WHEREAS, the said ordinance was duly published as required by law; and WHEREAS, pursuant to authority provided by statute has been filed with the legislative body of the City of Baldwin Park signed by more than ten percent of the number of qualified registered voters of the City of Baldwin Park protesting against the adoption of the said ordinance herein- above referred to; and WHEREAS, the City Clerk of the City of Baldwin Park has duly examined and from the records of registration ascertained that the petition is signed by the requisite number of voters, and has so certified; and WHEREAS, the City Council of the City of Baldwin Park has not voted in favor of the repeal of the Ordinance; and WHEREAS, the City Council of the City of Baldwin Park, California, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER as follows: SECTION 1. That a special election be held and the same is hereby called to be held in said city on November, 1986, for the purpose of submitting to the qualified voters of said city an ordinance hereinafter set forth relating to the Sierra Vista Redevelopment Project, a Redevelopment Plan for the City of Baldwin Park. SECTION 2. That the ordinance submitted to the voters shall be as follows: BIB] 37847-U01 1986-U02 077-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20600-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1986 077 CC RESO;¢fìø¤ORDINANCE NO. 947 AN ORDINANCE OF THE CITY COUNCIL OP THE CITY OF BALDWIN PARK APPROVING AND ADOPTING THE REDEVELOPMENT PLAN FOR THE SIERRA VISTA REDEVELOPMENT PROJECT THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN AS FOLLOWS: SECTION 1. THE CITY COUNCIL of the CITY OF BALDWIN PARK does hereby find, determine and declare as follows: a) That the Community Redevelopment Agency of the City of Baldwin Park, California/ hereinafter referred to as the Agency", has formulated and prepared the proposed Redevelopment Plan for the Sierra Vista Redevelopment Project hereinafter referred to as Redevelopment Plan"; and b) That the Planning Commission of the City of Baldwin Park submitted its report and recommendation finding said proposed Redevelopment Plan to be in conformity with the City's General Plan and recommending approval and adoption of said proposed Redevelopment Plan; and c) That the Agency submitted to the Baldwin Park City Council, hereinafter referred to as Council", said proposed Redevelopment Plan/ accompanied by the Report of the Agency on said proposed Redevelopment Plan, which Report contains among other things, the Planning Commission's report and recommendations, the Final Environmental Impact Report on said proposed Redevelopment Plan/ the Report to the County Fiscal Officer and analysis thereof by the Agency, and the Report of the Fiscal Review Committee; and d) That the Agency adopted rules governing participation by and reasonable preferences to property owners, operators of businesses and tenants in the Project Area; and e) That the Agency consulted with the taxing agencies which levy taxes, or for which taxes are levied, on property in the Project Area with respect to the proposed Redevelopment Plan and to allocation of taxes pursuant to Section 33670 of the California Community Redevelopment Law; and f) That the Council certified that the Final Environmental Impact Report for the proposed Sierra Vista Project Area was prepared and completed in accordance with the California Environmental Quality Act of 1970 Public Resources Code 21000 et seq., CEQA") and state and local regulations and guidelines adopted pursuant thereto; and g) That after due notice, a joint public hearing was held by this Council and the Agency to consider said proposed Redevelopment Plan; and BIB] 37847-U01 1986-U02 077-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20600-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1986 077 CC RESO;¢fìø¤ORDINANCE NO. 947 PAGE TWO h) That at said joint public hearing, this Council heard and passed upon all oral and written objections by overruling said objections; and i) That all actions required by law have been taken by all appropriate public agencies. SECTION 2. The purposes and intent of the City Council with respect to the Project Area are to: a) Eliminate the conditions of blight existing in the Project Area; b) To prevent recurrence of blighting conditions within the Project Area; c) To provide for participation by owners and tenants and preferences to persons engaged in business within the Project Area to participate in the redevelopment of the Project Area; to encourage and ensure the redevelopment of the Project Area in the manner set forth in the proposed Redevelopment Plan; and to provide for the relocation of residents, if any, displaced by the implementation of the proposed Redevelopment Plan. d) To improve and construct or provide for the construction of public facilities, roads, and other public improvements and to improve the quality of the environment in the Project Area to the benefit of the Project Area and the City of Baldwin Park as a whole; e) To encourage and foster the economic revitalization of the Project Area by protecting and promoting the sound development and revitalization of the Project Area and by replanning, redesigning or redeveloping portions of the Project Area which is stagnant or improperly utilized because of the lack of adequate facilities, utilities and other causes; and f) To provide housing as required to satisfy the needs and desires of the various age, income and ethnic groups of the community. SECTION 3. All written and oral objections to the Redevelopment Plan are hereby overruled. SECTION 4. The proposed Redevelopment Plan is hereby approved and adopted and designated as the Official Redevelopment Plan for the Sierra Vista Redevelopment Project Area, and the same is attached hereto and incorporated herein by reference as if set forth in full and marked as Exhibit A". SECTION 5. The City Council hereby finds and determines that: a) The Project Area is a blighted area, the redevelopment of which is necessary to effectuate the public purposes as set forth in the Community Redevelopment Law of the State of California; BIB] 37847-U01 1986-U02 077-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20600-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1986 077 CC RESO;¢fìø¤ORDINANCE NO. 947 PAGE THREE b) The Redevelopment Plan will effectively redevelop the Project Area in conformity with the California Health and Safety Code, Section 33000 et seq.; f) The condemnation of real property, as provided for in the Redevelopment Plan is necessary for the execution of said Redevelopment Plan and adequate provisions had been made for payment for property to be acquired, as required by law; g) The A9ency has a feasible method or plan for the relocation of families and persons to be temporarily or permanently displaced from facilities within the Project Area; h) There are or are being provided in the Project Area or in other areas not generally less desirable in regard to public utiities and public and commercial facilities and at rents or prices within the financial means of the families and persons displaced from the Project Area, decent, safe, and sanitary dwellings equal in number to the number of and available to such displaced families and persons and reasonably accessible to their places of employment; i) Inclusion within the project of any lands, buildings, or improvements which are not detrimental to the public health, safety, or welfare is necessary for the effective redevelopment of the area of which they are a part; any such area included is necessary for effective redevelopment and is not included for the purpose of obtaining the allocation of tax increment revenues from such area pursuant to Section 33670 of the Community Redevelopment Law without other substantial justification for its inclusion; j) The elimination of blight and the redevelopment of the Project Area cannot be reasonably expected to be accomplished by private enterprise acting alone without the aid and assistance of the Agency; k) The effect of tax increment financing will not cause a significant financial burden or detriment on any taxing agency deriving revenues from the Project Area, SECTION 6. In order to implement and facilitate the effectuation of the Redevelopment Plan hereby approved and adopted, it is found and determined that certain official actions must be taken by the City Council with reference, among other things, to the vacating and removal of streets, alleys, and other public ways, the establishment of new street patterns, the location and relocation of sewer and water mains and other public facilities, and other public action, and accordingly, this Council hereby: a) Declares its intention to undertake and complete any proceedings necessary to be carried out by the City of Baldwin Park under the provisions of the Redevelopment Plan. SECTION 7. This Council is satisfied that permanent housing facilities will be available within three 3) years from the time occupants of the project are displaced and that pending the development of such facilities there will be available to such displaced occupants adequate temporary facilities at rents comparable to those in the City of Baldwin Park at the time of the displacement. SECTION 8. The City Clerk is hereby directed to file a e©rtifi@d"eopy~of this Ordinance with the Secretary of the Redevelopment Agency, and the Agency is hereby vested with the responsibility for carrying out the Redevelopment Plan. SECTION 9. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be published in the manner prescribed by law. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until eight o'clock P.M. of the same day, when said polls shall be closed/ except as provided in Section 14301 of the Elections Code of the State of California. SECTION 4. That on the ballots to be used at said special election, in addition to any other matters required by law, there shall be printed substantially the following: Shall Ordinance No. 947, Adopting The Redevelopment Plan For The YES Sierra Vista Redevelopment Project be approved? NO SECTION 5. That a vote placed in the voting square after the word YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A vote placed in the voting square after the word NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. SECTION 6. That the special election hereby called for the date hereinbefore specified shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within said city the precincts, polling places and officers of election for the special municipal election hereby called shall be the same as those provided for said statewide general election. The Board of Supervisors of Los Angeles County is hereby requested to order the consolidation of the special municipal election hereby called with said state- wide general election, and said Board of Supervisors is hereby authorized to canvass the returns of said special municipal election/ and said elections shall be held in all respects as if there were only one election, and only one form of ballot, namely, the ballots used at said general election, shall be used. Said Board of Supervisors shall certify the results of the canvass of the returns of said special municipal election to the City Council of said city which shall thereafter declare the results thereof. A proposition submitted by this resolution shall be disignated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 10219 of the Elections Code, SECTION 7. That notice of the time and place of holding said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in time, form and manner as required by law. SECTION 8. That the City Clerk shall certify to the passage and adoption of this Resolution; shall enter the same in the book of the original Resolutions of said City; and shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City, in the minutes of the meeting at which the same is approved and adopted.
