RESOLUTION NO. 86-99
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF BALDWIN PARK DENYING
A CHANGE OF ZONE FROM 01 TO 01 0)
APPLICANT: REGENCY OUTDOOR
ADVERTISING INC.; CASE NO.: Z-461;
LOCATION 12911 E. GARVEY AVENUE.)
THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES ORDAIN
AS FOLLOWS:
SECTION 1. That the City Council of the City of Baldwin
Park does hereby find, determine, and declare as follows:
a) That an application for a change of zone from
01, Office Industrial to 01 0) Office Industrial
Outdoor Advertising Overlay was submitted by the
owners of real property located at 12911 E. Garvey
Avenue, described, more particularly as follows:
Lot 7, Block A, Tract 10953 Map Book 793, Pages
44 & 45 of the Los Angeles County Assessor's
records shown on Exhibit C"; and
b) That pursuant to the applicable provisions of the
Planning and Zoning Law Section 65800 et. seg. of
the Government Code of the State of California)/
studies were commenced for the purpose of amending
the Zoning Map of the city of Baldwin Park; and
c) That a duly noticed public hearing was held upon
said matter by the Planning Commission, and based
upon the evidence presented, it determined that
the public necessity, convenience, and general
welfare did not require that it recommend the
approval of the reclassification to 01 0); and
d) That the City Council conducted a duly noticed
hearing on said matter, and based upon the evidence
presented, and each member being familiar with the
site, it was determined that the public interest,
necessity, convenience, and general welfare re-
quired the change in zone classification, herein
described, be denied based on the following find-
ings
I. The permitted use by the proposed zone could be
detrimental to surrounding properties; and
II. The proposed zone change is inconsistent with
some general plan policies and inconsistent
with the Sierra Vista policies of eliminating
freeway corridor blight; and
III. The proposed zone change is not a logical and
rational reclassification of the land.
SECTION 3. That the City Clerk shall certify to the
adoption of this Resolution, and shall forward a copy of the same to
the applicant and to the Secretary of the Planning Commission.
PASSED AND APPROVED this 5th day of November, 1986.
