HomeMy WebLinkAbout1986 102 CC RESO1986 102 CC RESOøARESOLUTION NO. 86-102 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DENYING A REQUEST FOR ZONE VARIANCES APPLICANT: REGENCY OUTDOOR ADVERTISING INC.7 LOCATION: 12737 GARVEY AVENUE; CASE NO.: ZV-548). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare/ as follows: a) That the owners of certain real property, located at 12737 Garvey Avenue more particularly described as Parcel 31 on Page 5 of Map Book 8550 of the Los Angeles County Assessor, heretofore made application for a zone variance, as hereinafter described; and b) That the zone variance application seeks permission to allow the following: I. An outdoor advertising structure to exceed the maximum height Section 17.32.190.F of the City Code); and II. An outdoor advertising structure to exceed the maximum sign face area Section 17.32.190.G of the City Code); and c) That the said matter was considered by the Planning Commission, which body denied the application; and d) That a timely appeal was taken, appealing the Plann- ing Commission's decision to the City Council; and e) That the City Council conducted a duly noticed public hearing upon the said matter and determined that the facts required pursuant to the provisions of the Baldwin Park Zoning Code for the granting of a zone variance were not present, to wit: I. That there are no exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of such property, which do not generally apply to other property in the same zone or vicinity; and II. That such variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property similarly situated; and III. That the granting of the variance could be materially detrimental to the public welfare or injurious to the adjacent property, as granting the variance could decrease the development potential of adjacent property and establish a precedence; and BIB] 37847-U01 1986-U02 102-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20545-U03 DO20575-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1986 102 CC RESOøAIV. That the granting of the variance will adversely affect the General Plan of the City as this proposal is in conflict with policies of the Community Design and Scenic Highway Elements as well as policies of the Sierra Vista Redevelopment Plan. f) That based upon the above findings of fact, the application should be denied. SECTION 2. That the zone variance application, as herein- above described, be and the same hereby is denied. SECTION 3. That the City Council relied upon the evidence presented at the public hearing in making the above findings of fact, and in reaching the conclusion that the zone variances should be denied. SECTION 4. That the City Clerk shall certify to the adop- tion of this Resolution and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant.
