HomeMy WebLinkAbout1987 003 CC RESO1987 003 CC RESO÷ÿRESOLUTION 87-3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BALDWIN PARK APPROV- ING A DEVELOPMENT PLAN FOR A 38 UNIT SINGLE FAMILY PLANNED DEVELOPMENT AND APPROVAL OF A TENTATIVE TRACT MAP FOR A 39 LOT SUBDIVISION APPLICANT: ALEXANDER/CATANIA; CASE NO.: 2-464 & TM 44977, LOCATION: 12845, 55 & 67 SALISBURY STREET). THE CITY COUNCIL OF THE CITY OF BALDWIN PARK DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Baldwin Park does hereby find, determine and declare as follow: a) That the owners of certain real property located at 12845, 55 & 67 Salisbury Street, heretofore filed an application for an approval of a Development Plan/ pursuant to Chapter 17.30 of the Baldwin Park Municipal Code, and approval of a Tentative Tract Map pursuant to the State Subdivision Map Act/ to allow the construction of a 38 unit planned development; and b) That the real property hereafter Property") to which this application relates is more particulary described in the said application which is on file in the office of the Secretary of the Planning Commission of the City; and c) That the City Council conducted a duly notice public hearing upon said matter, and based upon the evidence presented and each Member of the Council being familiar with the Property, determined that the said application should be granted, subject to the terms and conditions hereinafter set forth. SECTION 2. That the City Council does hereby adopt the follow- ing Findings of Fact; a) That the proposed development is consistent with the policies of the General Plan; and b) That the proposed development is not detrimental to surrounding properties; and c) That the proposed project is a logical development of the land; and d) That the proposed development meets the purpose and intent of the Planned Development Overlay Ordinance. SECTION 3. That the above described Development Plan be, and the same hereby is granted, subject to the following conditions: a) That the subject property shall be developed and maintained in substantial compliance with Exhibit A" dated December 10, 1986 with the following modifications: 1. That a six 6) foot high stucco coated block wall shall be installed along the rear property lines of lots 13 thru 16 and 17 thru 20 and adjacent to Salisbury Street; and BIB] 37847-U01 1987-U02 003-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20558-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 003 CC RESO÷ÿ2. Specimen trees of 24 inch box size or greater shall be planted in the entrance areas and the central common open space area; and 3. The meandering sidewalk adjacent to Salisbury Street shall be relocated to the public right of way and re- placed with landscaping; and b) The CC&R's shall reflect that the homeowner's association shall maintain all common areas and the landscaping of the front of each unit outside of the walled yard/ the maintenance of the walls located on a property line, and that future unit expansions shall be limited to patio covers only/ which shall not exceed 25 percent of the lot's private open space; a three 3) foot side yard area/ ex- cept that an existing zero 0) side yard area building line may be continued/ and a five 5) foot rear yard area shall be maintained for said units; and c) That the CC&R's shall note that the private street is a fire lane/ and No Parking" signs shall be posted and maintained for said street; and d) That the CC&R's shall include the City's resolution of approval as an addendum; and e) That design approval is subject to this project meeting all design requirements of the Los Angeles Fire Department/- and f) That electric garage door openers be provided for each unit; and g) The applicant shall enter into an agreement for individual on-site pick-up with the refuse company; and h) On-site private street shall be designed as a standard public street" section with a crown along the centerline and an intergral curb and gutter/ an on-site street lighting plan is to be included within the architectural drawings; and i) That the walls between properties shall be as shown on Ex- hibit D"/ except that the posts shall have a steel baseb- and j) That the applicant shall submit to the Planning Division revised site plans and architectural drawings/ landscape, irrigation plans, street light design/ and CC&R's for review and approval; and k) That construction shall commence within one 1) year of the effective date of City Council approval/ or approval of the development plan is null and void; and 1) The applicants shall install all public improvements as required by the Engineering Division and Fire Department; and m) That the applicant shall submit for approval a final map with CC&R's. Said map shall show a common lot which shall include the private street and all common open space areas; and BIB] 37847-U01 1987-U02 003-U02 CC-U02 RESO-U02 LI3-U03 FO2126-U03 FO20370-U03 DO20558-U03 C6-U03 RESO-U03 8/12/2003-U04 ROBIN-U04 1987 003 CC RESO÷ÿn) That the applicant shall submit for approval a grading plan, soils report and a sewer plan pursuant to City standards 7 and o) That the applicant shall sign a notarized affidavit within twenty 20) days after the adoption of the resolution that the applicant has read and accepts all the conditions of approval. SECTION 4. That the City Council relied upon the administra- tive Record, and the evidence presented at the public hearing in reaching the conclusion that the Development Plan should be condition- ally approved. SECTION 5. That the City Council does hereby approve and adopt as a result of its said considerations, the Negative Declaration that has been prepared and considered pursuant to the provisions of CEQA, the State CEQA Guidelines, and the City's procedures. SECTION 6. That the City Clerk shall certify to the adoption of this Resolution, and shall forward a certified copy hereof to the Secretary of the Planning Commission and to the applicant. The City Clerk shall file and post the Negative Declaration in the manner pre- scribed by law. PASSED AND APPROVED THIS 7th day of January 198/7 x^ MAYOR ATTEST: IjX^DA L.
